Vice President Malloy noted that all the strike outs for the Energy Resources Analyst were in the areas where the employee would be assisting with certain tasks and wanted to know who would now prepare them. Senior Human Resources Analyst, Chris Low responded that the bargaining unit had last minute questions for this classification and that this spec should have been pulled back for this meeting and be brought back in the January 2017 Civil Service Board meeting. Human Resources Director Bronstein wanted to make note that for the Meter Technician and Substation Technician classifications, both have been modified to say that you must have good color vision instead of freedom from color blindness, to allow for the interactive process. Vice President Malloy wanted to understand the reason for the new specification, Crime Prevention Technician. HR Director Bronstein answered that currently sworn officers are doing some of the duties, even though it is not a sworn position, and then office managers are doing some of the duties. If the Board does not feel that they will get a fair analysis then do not take her up on her offer and she will save her funds for something else. Mr. Peterson stated that he thinks at City Attorney Kern's direction, is she going to direct them to look at things that may make their (the City's) case weaker. That is his point. City Attorney Kern stated that she would ask the Board to direct what they want done. But Mr. Peterson needs to understand that their (the Board's) lawyer is going to help keep them contained into what is in their purview and it is not going to be who gets the job and who does not get the job. It is going to be if the process was fair and if the process is found to not have been fair, then what they (Board) have the authority to do is vacate the whole thing and start all over again. Mr. Peterson asked a hypothetical, if the Board finds that two of the people do not have the qualifications to be considered for the job, would that be enough to say it was not fair. Mr. Riddle stated that hypotheticals are really not what the Board should be doing at this point. The Board ought to be making a decision about whether they have the information they need and what process is needed to go forward. President Peeler stated the Board feels they need more time and discussed when they would like to next meet. Mr. Riddle stated that the Board needs to meet again to determine the steps needed to be going forward after they read all the material. HR Director Brock-Cohn stated that the next regularly scheduled Civil Service Board meeting is Wednesday, July 11, 2012. Executive Secretary Willis stated that there had not been any. 5-B Article VII. Eligible Lists Chris Low shared that Human Resources staff met regarding continuous eligible lists. A decision was made based on a suggestion from the Civil Service Board. He explained that one eligible list will be used, and based on test scores candidate names will be merged onto this list. Subsequent names will be added as continuous testing occurs. Board Member Peeler asked when the list would expire. Chris Low explained that names would be placed on the eligible list for six months and would then be extended individually if the candidate was still being considered after the initial six month period. Board President Rich asked how many times someone could be extended. Jill Kovacs explained that a name can be certified for up to two years in six month increments. Chris Low also shared that the Police Department is currently two candidates away from being fully staffed, but that there are seven or eight more retirements expected within the coming year. Executive Secretary Willis stated that Alameda Power and Telecom is no longer staffing Studio 31. Of the two people employed at Studio 31, one has been reassigned and the other has been layed off. She also stated that Human Resources has noticed the bargaining unit regarding the lay-off. She explained that Studio 31 will still exist but if the public wishes to use it Alameda Power and Telecom will no longer help. There have been a lot of elimination and readjusting of positions. This was a new classification requested to help them better manage the functions of the Community Development Department. Member Malloy stated she wanted to get a sense of what people, who work for the city, would be potential candidates. Brock Cohn stated that she would have to go back and check. She believes that anybody who is currently a planner would be eligible, or most likely would qualify. But, she needs to confirm and get back to the Board. Ms. Kovacs responded that not all positions in these classifications will be required to drive and leaving it this way provides the City more flexibility. Member Batchelor stated that he understood the Planner I may only be at the counter, but that he thought the Planner Il would be required to go out in the field and would need the license. Ms. Kovacs explained that this was generally true; however the City has traditionally used this language for flexibility as not all the Planner Il's will work in the field. Executive Secretary Willis stated that if we were a larger organization, we could have the more restrictive language. However, because we are small, we would like to have the flexibility to utilize Planner I or Planner Il classifications for field work as needed. He stated that the briefs would provide the Board with background information and a preview of arguments and evidence that would be presented. Mr. Judson then went over the hearing procedures handout. He stated that each side has the option for an opening statement if they choose. He stated that the City would present its case first and present any witness testimony. With each witness there would be an opportunity for each side to cross-examine the witness followed by questions from the Board, if any. Then the City would be able to redirect. It is not rebuttal as shown on the handout. This is followed by the Appellant's re-cross examination. A redirect follows the scope of the prior re-cross examination. New issues cannot be brought up while under re-cross examination. This process can go multiple rounds. Mr. Judson explained that after that process is concluded then the Appellant makes their presentation and the process repeats itself. At the end, there is an opportunity for the City to offer any rebuttal to the Appellant's case. This is the time for the City to re-butt any facts or evidence presented by the Appellant. Then the same process is followed for re-cross examination, redirect, and re-cross as appropriate until the closing arguments. Mr. Judson explained that the closing arguments are like the opening statements in that there is no obligation to present a closing argument. The opening statement is a preview of the evidence to be presented and the closing argument summarizes what the evidence showed. Their name(s) would remain on the list because they had passed the examination process, however the list would not have any viable candidates to choose from and would be cancelled. Member Batchelor asked about the position changes at Alameda Municipal Power (AMP). He asked the reasoning behind these changes and if these changes caused the City to be at risk by moving them from the City Information Systems (IS) to more of a specialized utility classification. He was specifically concerned if there would be any negative impact or risk should lay-offs result. Executive Secretary Willis stated that there were some vacant positions that were either unfunded or eliminated, but that they are not tied to the budget because there is no money tied to them. Board President Rich then asked if the City was in a hiring freeze. Executive Secretary Willis explained that the 2008/09 budget passed and because of this the City is able to fill budgeted positions. She also stated that two positions were eliminated that had people in them, and those people then exercised their bumping rights. The Police Department is now having difficulty finding good candidates and would like to recruit on a continuous basis to have the flexibility to establish multiple eligible lists, and to be able to use them simultaneously. He also shared that it takes over a year to put an Officer on the street, and many other Police departments are experiencing the same problems in finding qualified individuals. Board President Michael Rich questioned what the difference would be between having multiple eligible lists and adding to the current one. Chris Low explained that eligible lists are typically the order in which people are hired. The City of Alameda exhausts the current list and then establishes a new one, but that a single list might also be a possibility. Board President Michael Rich asked if having multiple lists would be confusing and stated that he would like to see new names merged onto one list instead. Both lists were cancelled on the same day they were established. Acting Human Resources Director Kovacs stated that these lists each had one candidate. Senior Human Resources Analyst Low stated that for both jobs there was only one candidate placed on the eligible list for each position. Both were offered appointment and both accepted. As a result, each eligible list was exhausted on the same day it was established. Vice President Batchelor asked if the City was satisfied with these positions being offered for that short of time. Senior Human Resources Analyst Low stated that the candidates were in-house and that internal promotional exams were conducted. Acting Human Resources Director Kovacs advised the Board that when there is a "PR" after the exam number that means it is a promotional recruitment. Vice President Batchelor asked if the IBEW will be agreeable with the Line Working Supervisor job specification revision to duty #6 (assists in the supervision, training and evaluation of assigned staff). Senior Human Resources Analyst Low stated that the description was vetted to the IBEW and they agreed. It seems like there are a lot of duties for this one individual. Acting Human Resources Director Kovacs stated there are a lot of duties. Right now they have a dedicated maintenance/custodian position. Over time the position has evolved and the work requires proficiency in specialized needs of the Police Department. For instance, troubleshooting the issues with the security systems, sirens on automobiles, and coordination of taking vehicles to the shop, etc. It is anticipated that this would be a promotional opportunity. It is not appropriate to upgrade the position to a Maintenance Worker Il because the specialization and nature of the work is not interchangeable with what would be represented by a Maintenance Worker II in Public Works. The skill set is very different. Vice President Batchelor stated that it seems that Public Works should be able to take care of the building. Acting Human Resources Director Kovacs stated that is correct. But they only have one position in the Police Department. There is one remaining vacant position and the one candidate left on the list was not strong in the particular skill area of the current position vacancy. She started her career 25-30 years ago with the City of Burbank, then moved up to the Bay Area and went to work for the Town of Danville. From there she went to Antioch, then Hayward, and most recently was with the City of Livermore. Senior Management Analyst Kovacs alerted the Board that there was another round of layoffs due to the transfer of the City's Animal Shelter to the non-profit group FAAS (Friends of the Alameda Animal Shelter). There were 5 full-time employees affected; 2 were able to keep jobs, one by bumping into a vacant position at the Police Department and the other by bumping into a position at the Public Works Department recently vacated due to promotion of the incumbent to a position at the Housing Authority. Assistant City Attorney Highsmith addressed these concerns and stated that the case is never discussed between attorneys prior to the hearing, and Ms. Highsmith's sole responsibility is to advise the Board on procedure when questions arise. Assistant City Attorney Highsmith spent some time breaking this down for the members, and responding to the questions posed surrounding limitations of authority. While Assistant City Attorney Highsmith was present, a question came up on the proper procedure for agendizing items for future meetings. Ms. Highsmith advised that Executive Secretary Willis was their liaison in this matter, and she would be the one to set the agenda, including items of interest to the Board members. Member Smith stated his preference to make his requests through Chair Robles-Wong, who would then work through Ms. Willis, and it was agreed that this was a perfectly acceptable alternative. In light of this, two requests were made to agendize items for the upcoming July 2005 meeting. He also shared that some employees have already been told they would be losing their jobs. He went on to question how the City determines who has seniority over who. She stated that although the use of cell phones during a public meeting was not a violation of the Brown Act, that the use of a cell phone during a meeting could result in someone not being able to hear both sides of the conversation, thus possibly creating an issue for the public. The City Attorney wanted to make certain that the Boards were cognizant of this and for the Boards to be made aware so that they would be sensitive to the issue. The Board could ask the witnesses to leave the room while other testimony was being given, but this request could not be enforced. If this were a closed session setting, the witnesses would be sequestered and brought in one at a time for their testimonies. The subject of impartial legal advice arose again, and Ms. Highsmith reiterated the position of the City Attorney's office in that there is no correspondence prior to a hearing between the Board's attorney and the attorney presenting the case against the appellant. Ms. Highsmith also advised the Board on procedures for handling objections. Member Robles-Wong asked that a small change be made to ARTICLE XI. PROCEDURE ON APPEALS under Section 3. NOTICE AND DECISION of the Civil Service Rules which states in part " Within ten (10) days after the hearing is concluded and the matter submitted for decision, the Board shall make its written decision To be more specific, the Board asks this statement be amended to read " Within ten (10) business days. This way they can either take a major project as their own project or supervise other project managers. The City wants someone with broad major project management experience. Once you have a skill as a manager it can be adapted to other things if you know the field. Project management is a specific skill set. The Police Technician wears a uniform, works varying shifts, possibly including holidays, etc. The Police Maintenance Technician does not work on holidays, does not wear a uniform, and that employee is not going to be involved in law enforcement code work. Whereas, the Police Technician deals with abandoned vehicle reports, parking reports, etc. They are more involved in the direct nature of law enforcement. The Police Maintenance Technician does specialized skilled Police Department maintenance work, but is not regularly involved in activities that directly support law enforcement.
