Board President Robles-Wong asked whether the new classifications created a competitive situation for the individuals who were re-assigned into a new job title, and questioned whether or not those individuals were required to re- test. Executive Secretary Willis stated that none of the individuals involved were required to re-test for their positions. Board President Robles- Wong expressed concern that if the Civil Service Rules were not followed, the employees who were re-assigned were not being protected by the system that was designed to do just that. He suggested that there should be a special meeting called in cases when individuals are involved. Member Rich also requested a special meeting to discuss personnel actions and procedures, and Member Peeler agreed. The Board agreed that a special meeting would be scheduled for mid- November. Member Rich moved to approve item 4-D with the understanding that staff will agendize a separate item on the next agenda to provide procedural background on the reclassification process. Member Peeler seconded the motion and was carried by a 3-0 vote. 5. REGULAR AGENDA ITEMS 5-A Activity Report - June 1, 2006 through August 31, 2006. Executive Secretary Willis presented the Board with Turnover Statistics as requested by Board Member Rich at the July 12, 2006 meeting. She stated that the report showed percentages of resignations, retirements and other separations for Miscellaneous and Safety employee groups back to the year 2001. She explained that resignations had risen significantly in the last two years. Member Rich asked if there was any idea why. Chris Low stated that this is the first time the City has used the new system regarding the continuous postings of police officer positions. Executive Secretary Willis asked if in the future as new names are added, what would the Board see, the entire list or only the newly certified names? Chris Low responded that only the new names would be certified to the Board. Member McHugh stated that she thought this seemed like a good list. Chris Low stated that it is a good list but there are other steps that must be taken such as the background check which may potentially eliminate many of the names. Vice President Horikoshi moved to accept the consent calendar. Member McHugh seconded and the motion passed by a 4-0 vote. 5. REGULAR AGENDA ITEMS 5-A Activity Report Period of September 1, 2009 - November 30, 2009 Executive Secretary Willis explained that she had inadvertently left out the Activity Report from their packet. It was handed out to the Board. Member McHugh asked about the reason for the two separations. Staff responded that one was due to a resignation and the other due to a death. 5-B Civil Service Ordinance Executive Secretary Willis told the Board that the Civil Service Ordinance was passed by Council and had a new number. It has since been placed on the City website. General discussion ensued regarding the process and how long it had taken for this ordinance to be updated. 5-C Update on Reduction-In-Force Executive Secretary Willis updated the Board on the status of the lay-offs at the Golf Complex. She stated that eight employees were separated, one got another job with the City and one decided to retire. There is a job opening with Public Works and the City is hopeful that will result in someone else being able to get a position with the City. CIVIL SERVICE BOARD COMIMUNICATIONS (COMMUNICATIONS FROM STAFF) Executive Secretary Willis gave a brief update on the budget and stated that the Interim City Manager had met with the bargaining units to let them know that it was her intent to try to maintain the status quo and not have any additional lay-offs. Her plan is to roll the current budget for an additional year. This plan is contingent upon the State of California not taking cuts from the gasoline tax. 9. President Peeler asked for a motion to adjourn the meeting. Board Member Horikoshi moved to adjourn and Board Member McHugh seconded the motion. Discussion: Staff presented to the Board a report regarding Alameda Police Officers Association- Non- sworn (PANS) December 28, 2003 - December 24, 2006 MOU Implementation, Classification/ Step Reassignment of incumbent employees. The report was comprised of a list of incumbent PANS members involved in the December 26, 2004 classification reassignment and was provided to the Board as notice of the action for presentation to and affirmation of the Board. Board President Robles-Wong explained that he was surprised by how many employees were affected by the reclassification issue from last meeting. He stated that he would like job title assignments to be confirmed so that there will not be a question years from now that each person who was reclassified has permanent status. Executive Secretary Willis explained that there were no changes in qualifications or salary ranges, and there were no promotions given. Board President Robles-Wong stated that what needed to be clarified was that the position was filled without an exam process, and that it is legitimate because employees were "reassigned". Board President Robles-Wong commented that all reassignments should be brought to the Civil Service Board in the Activity Report along with New Hires, Promotions, etc. Member Rich commented that what happened to the employees who were reassigned is not well defined and asked if there was any correspondence to the Unions and Employees. Jill Kovacs shared that a letter was sent out. Member Rich shared that he would prefer to see the word "transfer", clearly defined in the Civil Service Rules, used in place of the word "reassignment". Board President Robles- Wong stated that he would like clarification placed in the personnel files of each employee who was affected by the reclassification that explains the word "reassign" should mean "transfer". Member Rocha made a motion to accept that "reassign" should mean "transfer" under the Civil Service Rules. Executive Secretary Willis explained that Firefighter/Paramedic was mistakenly left off of the classifications requiring professional certification or advanced degree. Current planning is when someone comes in at the counter and pulls permits, etc. The Department was reorganized so that there would be a City Planner position slightly higher than the Planning Services Managers so that all divisions would have a division head similar to the building official or economic development manager for consistency. This was to streamline operations. Member Malloy asked if it now is a City Planner above the current people applying for permits, etc. Director Taylor stated no, it is one City Planner - a division head for all of planning. HR Director Bronstein answered that currently there is only the Transportation Coordinator and the reason for adding the Senior Transportation Coordinator is because in the Base Reuse Department there is about $42 million in grants and the work that is being done and needs to be done are at a higher level and complexity. She added that there was a study done by an outside agency on the current position to see if the work being done warrants creating a higher level. The lower level position will remain to allow advancement and flexibility to fill in the future if the complexity of work is completed, but the work being done today is at a senior level. Vice President Malloy asked how many positions will this fill and HR Director Bronstein confirmed that there will be two (2) positions. Recommendation to Revise the City's Civil Service Rules on How Candidates shall be Scored, Ranked and Certified on the City's Eligibility Lists to Eliminate the Need to Break Ties in Final Scores Member Nolan asked clarification on the recommended Civil Service Rule change and how it will be applied. HR Director Bronstein explained that currently if two applicants receive the same score, one of the ways to break the tie is by how soon their application was received. This may leave the other candidate ranked for example number six on the eligible list and potentially not certified to the department if only the top five names are to be certified depending on the classification and number of vacancies. The rule change would remove the need to break ties and certify the top five ranks instead of five names. HR Director Bronstein continued with an example with the Firefighter recruitment where there was a tie within a tie which lead to examining further into another component to break the tie. Member Nolan asked if this happens frequently and HR Director Bronstein answered that it does happen often. Senior HR Analyst Young added that the only reason a tie break is required is because the language in the Civil Service Rules where you have to certify names not rank. Linda Justus, ACEA President, stated that they were supposed to have received copies of the Civil Service Rules that contained suggested changes, and that she was interested to see what changes the Board wanted to make. Board President Robles-Wong shared that Member Peeler's copy of the Rules had highlighted sections that she had questions about but did not include changes. Member Rich stated that the reason the letter had been sent out was because the Board wanted input from the Bargaining Units regarding things that needed to be changed or updated. Pam Sibley stated that she had attended the meeting to hear about the proposed changes and that the Rules language needed to be changed. This is one of the general classification positions being looked at where the position has evolved into a more specialized position. There are not many left. Member McHugh asked if the technical knowledge and skills that are required for the positions being separated out are all very different between the departments. For instance, the Library Circulation Coordinator specification, under employment standards and experience, they are looking for the knowledge and ability to deal with the Library environment and technology. It is in all the Safety MOU's. Only Chief of Police and entry Police Officer will go outside. The other people who operate the street sweepers are Maintenance Worker Il's and it is more of an intermittent part of their job. In the past the Early Morning Street Sweeper Operator has been paid with a differential, but the Public Works Director determined that the best way to handle the situation was to have a designated classification for the position and the differential is included in the salary. President Peeler stated that it seems they would not need supervision as much. President Malloy and Analyst Romeo responded affirmatively that union representatives, employees, and the general public have attended at various instances. 7. CIVIL SERVICE BOARD COMMUNICATIONS (COMMUNICATIONS FROM STAFF) President Malloy welcomed Member Hom to the board and thanked her for serving and asked if Member Hom had any questions. Member Hom inquired if the classification surveys for negotiations used other jurisdictions for comparison to remain competitive. Analyst Netto responded that we compare internal and external examples and misalignments were taken into account in revising specifications. President Malloy provided a brief summary on consent calendar items and regular calendar items and how the Board typically pulls an item for deeper consideration. President Malloy asked if the new City Attorney, Yibin Shen, would like to introduce himself and brief greetings occurred. 8. Motion was seconded by Members Nolan and Brandt which was passed by a 4-0 vote. Vice President Malloy requested to pull item 4-A-iv for further discussion. Vice President Malloy noted that all the strike outs for the Energy Resources Analyst were in the areas where the employee would be assisting with certain tasks and wanted to know who would now prepare them. Senior Human Resources Analyst, Chris Low responded that the bargaining unit had last minute questions for this classification and that this spec should have been pulled back for this meeting and be brought back in the January 2017 Civil Service Board meeting. Human Resources Director Bronstein wanted to make note that for the Meter Technician and Substation Technician classifications, both have been modified to say that you must have good color vision instead of freedom from color blindness, to allow for the interactive process. Vice President Malloy wanted to understand the reason for the new specification, Crime Prevention Technician. HR Director Bronstein answered that currently sworn officers are doing some of the duties, even though it is not a sworn position, and then office managers are doing some of the duties. HR Director Bronstein answered that to her understanding there is no one in mind and that they looked at other existing job spec from other cities to try to benchmark. Senior Human Resources Analyst Robin Young continued and explained that she surveyed different agencies and found that a majority of the specs had a combination of education and experience. Education for the most part topped out at a 2-year degree and some have preferred certificates. She said the department wanted to balance industry standards but also provide an opportunity for someone to learn the responsibilities. Vice President Malloy expressed that perhaps one of the survey elements should include how long this position has been in existence because current expectations from this employee may be different as a new spec and for this department. Member Brandt had a concern on #6 of the sample of duties for the Crime Prevention Technician where the person would perform residential and commercial inspections but there is nothing in education, experience, or knowledge that addresses these areas. HR Director Bronstein shared the same concern and did mention that as part of the experience, they added program administration activities to help address this. She clarified that on #6 in the duties are not actual inspections but giving residents an idea on how the area can be secure. Senior HR Analyst Young added that there are also other areas in the spec that include problem solving, decision making, and interpreting laws, which speak to their ability to understand the crime prevention elements of an environment. The top ten (10) on the list may not have their Paramedic so selective certification would allow to give names of those who have the Paramedic Certification, after first making sure the top ten (10) hasn't received theirs. This would allow not requiring to have the top ten (10) to come in for an interview for the purpose of reaching down the eligible list. The current incumbent would be reclassified to the new classification. Vice President Malloy preferred to change "conduct audits" listed under example of duties #3 because it implies they are auditing themselves. Senior Analyst Young clarified that most of the data that is being audited are entered by those out in the field such as Paramedics. It was agreed to change the term that will clarify what the incumbent will actually be doing. Member Brandt asked how "enthusiastic" listed under abilities, will be defined. Senior Analyst Young responded that perhaps a more appropriate word would be "positive" and will update the specifications to reflect the change. Member Brandt asked how years of work experience will equate to the two years of college coursework. Senior Analyst Young answered that subject matter experts will help review if the applicant has the technology experience to succeed in the position. The experience and education is written to capture those who may not have the education but have worked in the industry to gain the qualifications. The employee in the grant funded Division Chief position is moving into the Civil Service position and the other employee is being promoted into the grant funded Division Chief position. HR Director Bronstein added that employees are notified that those in grant funded positions depend on the availability of the grant. She added that the Civil Service process is still followed for grant funded positions. HR Analyst Netto stated that those who are disqualified at the minimum or best qualification review receives a generic notice that they have not been selected to move forward. The notice does not specifically state that the applicant did not meet minimum qualifications. Vice President Malloy asks how the applicants know that they can appeal the decision that they are not moving forward since the notice does not state that they do not meet the qualifications. HR Director Bronstein responds that the letter leaves it open for applicants to call. Vice President Malloy suggest perhaps send two different notices, one for those not moving forward due to the strength of the applicants, and another for those being disqualified, which then allows applicants to appeal the decision. Member Barde asked what the intent of the City Council was with the position. Director Bronstein stated it is a common class in police departments to get better data on what crimes are happening and finding better ways to respond. It is a statistical position, crunching numbers, for example, how to handle mental health calls. Council gave direction in the last Council meeting on how to handle mental health calls. Member Barde continued to explain his concern that this job and data is heavy on standard methods of policing and recent discussions about who is being policed and how interactions with public are being evaluated, with not much attention being paid to victims or equity or adverse interactions. President Malloy stated she believed Member Barde is speaking to who uses the data and is that data used for policy to reinforce that status quo. Director Bronstein noted that without the data it is hard to know what is working. President Malloy continued that the CSB role is not to speak to political policy, cultural competency, or emotional intelligence of how the data is used. She also asked if the process for this is basically looking at the incumbent's current duties or were there additional duties listed for what the needs of that position might be in the future. Acting Human Resources Director Kovacs stated that whenever a classification and the corresponding job specification is developed, the intent is that it is fluid and flexible, so that the job specification does not have to be reviewed and reapproved by the Civil Service Board every few months. Acting Human Resources Director Kovacs further stated that this is why job specifications say "Example of Duties." An incumbent might not necessarily perform every single duty that is listed in the specification at a given time. However, operational needs and employee duties may change in the department and the job specification is designed to accommodate such shifts. 5-B. The Board is charged with the making of policy and procedure. The City Manager and his staff have authority over the implementation and operations of these policies and procedures. Assistant City Attorney Highsmith spent some time breaking this down for the members, and responding to the questions posed surrounding limitations of authority. The Board and staff give their thanks to Ms. Highsmith for her direction. While Assistant City Attorney Highsmith was present, a question came up on the proper procedure for agendizing items for future meetings. Ms. Highsmith advised that Executive Secretary Willis was their liaison in this matter, and she would be the one to set the agenda, including items of interest to the Board members. Member Smith stated his preference to make his requests through Chair Robles-Wong, who would then work through Ms. Willis, and it was agreed that this was a perfectly acceptable alternative. In light of this, two requests were made to agendize items for the upcoming July 2005 meeting. Chair Robles-Wong requested that a discussion be held regarding Rule of the List and adjusting the language in the Civil Service Rules. Member Rich requested to see EEO- 4 gender and ethnicity data to further a discussion initiated by Member Smith regarding workforce diversity and its impact on community relations. Member Rich also suggested that the City's anti-discrimination policy might be amended to include a commitment to recruitment outreach as a good faith effort to promote workforce diversity. GENERAL DISCUSSION OF CIVIL SERVICE RULES Member Nolan asked for clarification on the Civil Service Rules Section 1e of Article VII where it describes that those in a police academy or apprenticeship program may be placed on an eligible list by the HR Director. HR Director Bronstein explained that Police Officer Recruit is a part-time classification. Once the academy is completed in six (6) months, they are moved into the full-time Police Officer position without a new recruitment. HR Director Bronstein continued to explain that Firefighters are initially hired in a full-time Firefighter position while attending the academy. She also explained that apprentices are hired full-time then moved up.
