Member Rich abstained, as he was not present at the October 2004 meeting. 4. CONSENT CALENDAR: Member Rich asked that wording be clarified in the Video Production Artist job specification. Staff, without further need of approval by the Board, will make a minor change. Member Oddie made a motion to accept the Consent Calendar as presented, along with the wording change on the job specification. The motion was seconded by Member Smith and carried by a 4-0 vote. CIVIL SERVICE BOARD COMMUNICATIONS (COMMUNICATIONS FROM BOARD) Member Robles-Wong suggested that we add language to the Civil Service Rules under Article VII. Section 1 Establishment of Lists to include National Guard members in our definition of candidates with active military service who are eligible for an award of veteran preference points in our examination scoring process. Language will be revised by staff and presented at the April 2005 Civil Service meeting for approval by the Board. The Board is charged with the making of policy and procedure. The City Manager and his staff have authority over the implementation and operations of these policies and procedures. Assistant City Attorney Highsmith spent some time breaking this down for the members, and responding to the questions posed surrounding limitations of authority. The Board and staff give their thanks to Ms. Highsmith for her direction. While Assistant City Attorney Highsmith was present, a question came up on the proper procedure for agendizing items for future meetings. Ms. Highsmith advised that Executive Secretary Willis was their liaison in this matter, and she would be the one to set the agenda, including items of interest to the Board members. Member Smith stated his preference to make his requests through Chair Robles-Wong, who would then work through Ms. Willis, and it was agreed that this was a perfectly acceptable alternative. In light of this, two requests were made to agendize items for the upcoming July 2005 meeting. Chair Robles-Wong requested that a discussion be held regarding Rule of the List and adjusting the language in the Civil Service Rules. Member Rich requested to see EEO- 4 gender and ethnicity data to further a discussion initiated by Member Smith regarding workforce diversity and its impact on community relations. Member Rich also suggested that the City's anti-discrimination policy might be amended to include a commitment to recruitment outreach as a good faith effort to promote workforce diversity. Member Robles-Wong inquired if Executive Secretary Willis had spoken with other Department Heads to see if they would be comfortable going to this method. Ms. Willis expressed a general feeling throughout the City that for open/competitive examinations this would be an acceptable alternative to the current procedure, however, it would not be reasonable in the case of promotional examinations. She went on to explain the additional values of having a Rule of the List method in place, mainly by giving departments more alternatives in the interviewing process. He asked if departments are held accountable for fair interviewing practices i.e., do we require that they go down the list in order. Executive Secretary Willis explained it is always Human Resources instructions to the departments that they do that, however, there are no checks in place to ensure this procedure is followed. Before going forward with the Rule of the List implementation process, it was agreed that Human Resources would re-survey the cities originally polled in 2002 to see if they were still using the same methods. Human Resources will also research when rule of the list was implemented for the Fire Department's open/competitive examinations, and check the ethnicity stats surrounding that time period. 6. The results were pre- and post-rule of the list respectively. It was determined that there was only about a 1-2% difference in ethnicity statistics between the 1999 and 2001 reports, not enough to prove that going to rule of the list would be an added value to diversifying the organization. 5-C Procedure on Appeals (Article XI) was moved to the end of the agenda, to follow the scheduled closed session appeal hearing. 6. ORAL COMMUNICATIONS, NON-AGENDA (PUBLIC COMMENT) ACEA President Marion Miller expressed concern of potential conflict of interest when two attorneys from the same office represent the Civil Service Board, and also present the case against the appellant in a disciplinary appeal hearing. Assistant City Attorney Highsmith addressed these concerns and stated that the case is never discussed between attorneys prior to the hearing, and Ms. Highsmith's sole responsibility is to advise the Board on procedure when questions arise. Ms. Highsmith explained that because the prior hearing to which they were referencing was held as an open session, the witnesses were also members of the public, and could not, therefore, be barred from the proceedings. The Board could ask the witnesses to leave the room while other testimony was being given, but this request could not be enforced. If this were a closed session setting, the witnesses would be sequestered and brought in one at a time for their testimonies. The subject of impartial legal advice arose again, and Ms. Highsmith reiterated the position of the City Attorney's office in that there is no correspondence prior to a hearing between the Board's attorney and the attorney presenting the case against the appellant. Minutes reflect that the City is rescinding the cancellation of the Police Officer (Lateral) list, established on May 11, 2005 and cancelled at the Civil Service Board meeting on January 11, 2006. 5-B List of Positions Requiring Professional Certifications A list of positions requiring professional certifications or advanced degree was distributed as requested. Member Rich stated that this was the information he was looking for. He stated that he had been concerned about the merit process but felt like it made sense to give more latitude to management with regard to those positions that are difficult to fill. Staff was directed to prepare language to modify Article VIII, Section 1 to expand the rule-of-the-list principles established for Firefighters to include all those on the list of positions requiring professional certifications or advanced degrees. Member Rich further asked that a policy be developed where the appointing department head or supervisor would explain in their hiring recommendation why they jumped out of order. Board President Robles-Wong asked whether the new classifications created a competitive situation for the individuals who were re-assigned into a new job title, and questioned whether or not those individuals were required to re- test. Executive Secretary Willis stated that none of the individuals involved were required to re-test for their positions. Board President Robles- Wong expressed concern that if the Civil Service Rules were not followed, the employees who were re-assigned were not being protected by the system that was designed to do just that. He suggested that there should be a special meeting called in cases when individuals are involved. Member Rich also requested a special meeting to discuss personnel actions and procedures, and Member Peeler agreed. The Board agreed that a special meeting would be scheduled for mid- November. Member Rich moved to approve item 4-D with the understanding that staff will agendize a separate item on the next agenda to provide procedural background on the reclassification process. Member Peeler seconded the motion and was carried by a 3-0 vote. 5. REGULAR AGENDA ITEMS 5-A Activity Report - June 1, 2006 through August 31, 2006. Executive Secretary Willis presented the Board with Turnover Statistics as requested by Board Member Rich at the July 12, 2006 meeting. She stated that the report showed percentages of resignations, retirements and other separations for Miscellaneous and Safety employee groups back to the year 2001. She explained that resignations had risen significantly in the last two years. Member Rich asked if there was any idea why. Discussion: Staff presented to the Board a report regarding Alameda Police Officers Association- Non- sworn (PANS) December 28, 2003 - December 24, 2006 MOU Implementation, Classification/ Step Reassignment of incumbent employees. The report was comprised of a list of incumbent PANS members involved in the December 26, 2004 classification reassignment and was provided to the Board as notice of the action for presentation to and affirmation of the Board. Board President Robles-Wong explained that he was surprised by how many employees were affected by the reclassification issue from last meeting. He stated that he would like job title assignments to be confirmed so that there will not be a question years from now that each person who was reclassified has permanent status. Executive Secretary Willis explained that there were no changes in qualifications or salary ranges, and there were no promotions given. Board President Robles-Wong stated that what needed to be clarified was that the position was filled without an exam process, and that it is legitimate because employees were "reassigned". Board President Robles- Wong stated that he would like clarification placed in the personnel files of each employee who was affected by the reclassification that explains the word "reassign" should mean "transfer". Member Rich stated that some of the Department Head Titles do not exist anymore and that he would prefer to not see them all listed separately, but rather as "all department heads that report to the City Manager". 4-C Rule Change- Article VII, Appointment, Section 1. Executive Secretary Willis stated that Alameda Power and Telecom is no longer staffing Studio 31. Of the two people employed at Studio 31, one has been reassigned and the other has been layed off. She also stated that Human Resources has noticed the bargaining unit regarding the lay-off. She explained that Studio 31 will still exist but if the public wishes to use it Alameda Power and Telecom will no longer help. The City is required to have public access but is not required to staff it. Board Member Robles Wong questioned whether there has been a higher or lower percentage of turnover in the City. Board President Robles-Wong asked for input from members of the audience. Linda Justus, ACEA President, stated that they were supposed to have received copies of the Civil Service Rules that contained suggested changes, and that she was interested to see what changes the Board wanted to make. Board President Robles-Wong shared that Member Peeler's copy of the Rules had highlighted sections that she had questions about but did not include changes. Member Rich stated that the reason the letter had been sent out was because the Board wanted input from the Bargaining Units regarding things that needed to be changed or updated. Pam Sibley stated that she had attended the meeting to hear about the proposed changes and that the Rules language needed to be changed. Board Members, Rich, Robles-Wong and Peeler all agreed that the Board intended the changes to be "housekeeping" to update outdated language, but that if something in the Rules is wrong it needs to be changed. The Police Department is now having difficulty finding good candidates and would like to recruit on a continuous basis to have the flexibility to establish multiple eligible lists, and to be able to use them simultaneously. He also shared that it takes over a year to put an Officer on the street, and many other Police departments are experiencing the same problems in finding qualified individuals. Board President Michael Rich questioned what the difference would be between having multiple eligible lists and adding to the current one. Chris Low explained that eligible lists are typically the order in which people are hired. The City of Alameda exhausts the current list and then establishes a new one, but that a single list might also be a possibility. Board President Michael Rich asked if having multiple lists would be confusing and stated that he would like to see new names merged onto one list instead. Board Member Horikoshi shared that all agencies are having difficulties finding qualified people. Executive Secretary Willis stated that there had not been any. 5-B Article VII. Eligible Lists Chris Low shared that Human Resources staff met regarding continuous eligible lists. A decision was made based on a suggestion from the Civil Service Board. He explained that one eligible list will be used, and based on test scores candidate names will be merged onto this list. Subsequent names will be added as continuous testing occurs. Board Member Peeler asked when the list would expire. Chris Low explained that names would be placed on the eligible list for six months and would then be extended individually if the candidate was still being considered after the initial six month period. She stated that she had spoken with the City Attorneyand that her response was that "equal opportunity" was broader than "affirmative action", however she has not had the chance to put it in writing. Board President Rich stated that AffirmativeAction isn't illegal, and that he feared that people would think that the City is getting rid of its Affirmative Action program. Board Member Horikoshi argued that Affirmative Action programs of any kind are prohibited by State Law. Board President Rich stated that if you tailor it correctly it would not be illegal and that other agencies have them. He stated that he is hesitant to get rid of it without a letter from the City Attorney, and asked Executive Secretary Willis to write a letter from staff explaining why it is being removed from the Rules. Executive Secretary Willis stated that the City recruits as broadly as possible and places ads in publications that target specific groups such as Public Safety job fairs. Board Member Horikoshi stated that he would like the "affirmative action" language to be removed from the Rules. He explained that he doesn't want people to get the wrong idea that the City has an Affirmative Action program. Executive Secretary Willis stated that there were some vacant positions that were either unfunded or eliminated, but that they are not tied to the budget because there is no money tied to them. Board President Rich then asked if the City was in a hiring freeze. Executive Secretary Willis explained that the 2008/09 budget passed and because of this the City is able to fill budgeted positions. She also stated that two positions were eliminated that had people in them, and those people then exercised their bumping rights. He stated that the City's plan was to displace golf course employees and replace, by seniority, people in the Parks Department. He explained that there is a difference between golf course maintenance workers and parks maintenance workers and asked how golf workers are going to replace people in other job titles. He also shared that some employees have already been told they would be losing their jobs. He went on to question how the City determines who has seniority over who. Member Peeler stated that the Civil Service Board does not know what is happening at the Golf Course and that they will not know until a final decision has been made. Jill Kovacs stated that managers have met with employees to give them a heads up as to what could happen and that no official notice has gone out. Alan Elnick stated that the seniority structure has been shared with employees. He also stated that he does not understand who bumping rights apply to and how or why there is only one seniority list for three job titles. Derek Taylor stated that from his perspective the policy was that they were all Golf and Park Maintenance Workers and it was common knowledge that they could be moved from Golf to Parks. Parks employee Dennis Tavares stated that when he was hired his employment papers did not say anything about the Golf Course and that he was hired to work strictly at the baseball facility only. Board President Rich asked if the lay-offs were happening because of the change in management at the Golf Course or because of the budget. Karen Willis stated that it was happening because the Golf Course is losing money, and in turn, the City is leasing out the Golf Course. She also stated that once the Golf Course is leased out, those positions will be effectively eliminated from City jobs and will not come back if the economy improves. Executive Secretary Willis stated that the purpose of calling a special meeting was to bring more information to the Board to aid in the determination of the status of the Golf and Park Maintenance Worker as to whether or not it is one classification. Board President Michael Rich stated that it was his understanding that people could go through a grievance process if they believed that the lay-off had not been implemented correctly. Executive Secretary Willis stated that the ACEA Bargaining Unit does not have binding arbitration in their grievance process but that they do have an adjustment board process. Board President Rich asked if the City Manager has the ultimate say on the disposition of the grievance. Executive Secretary Willis stated that anything under a 30 day suspension would go directly to the City Manager, and anything over a 30 day suspension could either go to the City Manager or the Civil Service Board. John McDonald, Park Manager, stated that the confusion within the departments exists because there are people who were hired as Golf and Park Maintenance Workers and always knew that it was one classification and have always known that it is the same job. He further stated that in 1997 there was a Park Maintenance Worker bulletin that was posted that did not state that the position was both Golf and Parks and the people who were hired under that recruitment were never told that it was one classification. He stated that as jobs were created, the classifications were not separated, which caused even more confusion because there are people doing completely different jobs such as working in the pools and maintaining the Golf Course all under the same job classification. Board President Rich asked if there was ever an overlap of eligible lists for Golf and Park Maintenance Worker and whether or not there can be two lists that exist at the same time. Chris Low explained that only one list can exist at one time and that the Civil Service Board would have to give their approval to have more that one list at a time for the same position. She further clarified that the new specifications had salary ranges associated with them based upon an internal and external equity study which takes into consideration the knowledge, skills and abilities necessary for the classification. These new classifications and changes to current classifications came about as a result of a study conducted by an outside consultant to right-size AMP after the sale of the telecommunications business line. The consultant surveyed other municipal electric utilities companies and made recommendations based upon industry standards. She noted that several had a lot of duties listed and others did not. She also noted that these job specifications did not list the amount to time associated with each duty. Jill Kovacs responded that the City of Alameda did not list the amount of time, however the most important duties would be listed first and on down when the duties become more general in nature. Board Member McHugh stated that she had concerns regarding the Utility Billing services classification titles as the new job titles did not reflect that fact that these are jobs in the information technologies field. She stated that the old titles were more reflective of the duties than the new titles. She also expressed concerns with regard to the duplication of some of the job duties listed. He gave an example of a Public Safety Dispatcher recruitment where the candidates had passed the examination process and then failed to pass a background check. Their name(s) would remain on the list because they had passed the examination process, however the list would not have any viable candidates to choose from and would be cancelled. Member Batchelor asked about the position changes at Alameda Municipal Power (AMP). He asked the reasoning behind these changes and if these changes caused the City to be at risk by moving them from the City Information Systems (IS) to more of a specialized utility classification. He was specifically concerned if there would be any negative impact or risk should lay-offs result. Chris Low explained that the IS classifications at AMP and the IS classifications for the City have always been separate and distinct and as such, there would be minimal risk. Chris Low stated that this is the first time the City has used the new system regarding the continuous postings of police officer positions. Executive Secretary Willis asked if in the future as new names are added, what would the Board see, the entire list or only the newly certified names? Chris Low responded that only the new names would be certified to the Board. Member McHugh stated that she thought this seemed like a good list. Chris Low stated that it is a good list but there are other steps that must be taken such as the background check which may potentially eliminate many of the names. Vice President Horikoshi moved to accept the consent calendar. Member McHugh seconded and the motion passed by a 4-0 vote. 5. REGULAR AGENDA ITEMS 5-A Activity Report Period of September 1, 2009 - November 30, 2009 Executive Secretary Willis explained that she had inadvertently left out the Activity Report from their packet. It was handed out to the Board. Member McHugh asked about the reason for the two separations. Staff responded that one was due to a resignation and the other due to a death. 5-B Civil Service Ordinance Executive Secretary Willis told the Board that the Civil Service Ordinance was passed by Council and had a new number. It has since been placed on the City website. General discussion ensued regarding the process and how long it had taken for this ordinance to be updated. 5-C Update on Reduction-In-Force Executive Secretary Willis updated the Board on the status of the lay-offs at the Golf Complex. She stated that eight employees were separated, one got another job with the City and one decided to retire. There is a job opening with Public Works and the City is hopeful that will result in someone else being able to get a position with the City. Her plan is to roll the current budget for an additional year. This plan is contingent upon the State of California not taking cuts from the gasoline tax. 9. Jill Kovacs responded that if a new recruitment was opened now for Park Maintenance Worker, we would want park-focused experience. However, it would depend on the strength of the recruitment pool whether someone with other greens or landscaping experience would do well in the recruitment. Should the Golf Course reopen at some point, it would remain to be seen if we would expand this classification or create a second classification. Vice President Horikoshi stated that in terms of the examples of duties, he remembers previous discussions about swimming pools, baseball diamonds and tennis courts. He asked if recruitments tested generally for such position, or if there is a position that is going to work on swimming pools and do we recruit for someone with that kind of experience? Chris Low replied that a Maintenance Worker I recruitment is open now that specifies where that vacancy is and the recruitment is tailored to fill that particular vacancy. President Peeler asked if one classification is more mechanically oriented. Jill Kovacs replied that Park Maintenance Worker is focused on the out-of-doors. While they may do some restroom maintenance and some sorts of small building maintenance, by-in-large, they dealing with things that are outside. They are dealing with grounds or they are dealing with specialized recreational areas like tennis courts or ball fields. President Peeler asked if either of the maintenance classifications repair equipment. Chris Low explained that Maintenance Workers I in Public Works are more inclined to maintain things like curbs, streets, gutters, lift stations, signs, and striping on roads. They also do some weed abatement, concrete work, carpentry, plumbing and some electrical work. Chris Low concluded by saying that the Maintenance Workers in Public Works are diverse as opposed to those in Parks. Jill Kovacs further explained that the Maintenance Worker I is considered semiskilled and on-track to becoming a skilled worker such as the Maintenance Worker II. The Park Maintenance Worker is not on the same track and probably wouldn't move directly to a skilled Maintenance Worker II position. Vice President Horikoshi agreed that it does seem like they have different skill sets. Member Roberto Rocha asked how they would transition between the two. Jill Kovacs responded that not many Maintenance Workers from Public Works come to Parks, and not many from Parks go to Public Works, since they are totally different areas. Member Rocha asked if the layoffs were because there were no other positions with the City. Jill Kovacs explained that employees were either directly laid off or bumped out of their positions by employees with more seniority resulting in four Recreation and Park employees being bumped by Golf employees. The remaining Golf employees did not have seniority rights and they were directly laid off. There are exams going on now including Maintenance Worker l at Public Works, and these laid off employees have been invited to apply. President Peeler asked about the special notification list. Jill Kovacs explained that a special list of laid off employees is maintained, including employees who were part of the June 2009 City-wide Reduction in Force (RIF) and those impacted by the Golf layoffs at the end of 2009. AMP employees from an earlier lay off were also on the list, but have now rolled off. The contact list is used to invite and encourage laid off employees to apply for open positions. The June RIF layoff agreement provided that a laid off employee would retain rights to apply for internal promotional exams, or lateral or lower ones, and that the employee would be considered an active employee for the sake of their eligibility to apply. Board members discussed if the internal application was applicable for one or two years. Jill Kovacs confirmed the ability to apply for internal exams for one year and reinstatement rights to a position previously held for two years. President Peeler asked if the gasoline tax situation will create more layoffs. Jill Kovacs responded that there would be no further Golf layoffs because there are no Golf employees remaining. She stated that the City has opened up Police Officer for entry, academy graduate and laterals and received several hundred applications. The City has also opened up Maintenance Worker and received over 200 applications. Member McHugh asked about the quality of the candidates. Executive Secretary Willis stated that the review process was going on for these jobs so she did not have those results to be able to share with the Board. This list is then certifies to the hiring department. Thus, keeping with the Civil Service process and also allowing for better tracking of these laid off employees who are eligible for reinstatement. 5-C Cell Phone Use - Legal Opinion Executive Secretary Willis referred the Board to the legal opinion letter included in their Board packet. Member McHugh asked about how this issue came about. Executive Secretary Willis stated that she did not know the origin of this legal opinion but was advised that this needed to be shared with all Boards. She stated that although the use of cell phones during a public meeting was not a violation of the Brown Act, that the use of a cell phone during a meeting could result in someone not being able to hear both sides of the conversation, thus possibly creating an issue for the public. The City Attorney wanted to make certain that the Boards were cognizant of this and for the Boards to be made aware so that they would be sensitive to the issue. Executive Secretary Willis pointed out to that this has not been an issue with the Civil Service Board and would not expect that it ever would be. Mr. Low responded that the weight of the equipment is what determines the class of the driver's license and not necessarily the type of vehicle. Member Batchelor stated that the City may want to review this qualification in light of this job specification to make that determination. Member McHugh pointed out that the job specification calls for routine maintenance and the operation of heavy equipment. Having concurrent lists would allow for the current candidates to still be considered for openings that may occur without having the need to reapply. The City does not want to have to cancel the list and start a new one each time this happens. The City would prefer to keep the current list active and recruit separately for the specialized skills. President Peeler asked what the job title would be for this new recruitment. Mr. Low responded that it would be Police Records Supervisor. However, it was pointed out that this is a working title for the classification of Administrative Management Analyst which would be reflected on the recruitment notice. Member McHugh asked about bargaining unit rights and bumping rights issues. Executive Secretary Willis stated that bumping rights are based upon classification and that a laid off employee must be able to do the job they are bumping into.
