Member McHugh asked if there could be stress and hardship to remaining employees to do the work. Chris Low explained that the intention is to fill the Meter Reader Collector, Police Records Supervisor and Public Works Supervisor positions. Jill Kovacs stated that the Police Department is holding off on filling the Police Sergeant positions due to the Interim Chief of Police status and budget uncertainties; for now they are utilizing acting assignments for these positions. Chris Low further commented that for now, the majority of the positions are going to be filled, and that next fiscal year will be tighter and we will have to figure out how to make up the shortfall. Member McHugh asked if this was an opportunity to consolidate the Police Sergeant positions. Jill Kovacs responded that some consolidation was done in the last Reduction in Force, but that there was not as much flexibility remaining since most of the Sergeant assignments were to Patrol. 6. ORAL COMMUNICATIONS, NON-AGENDA (PUBLIC COMMENT) There was no one present from the public. 7. CIVIL SERVICE BOARD COMMUNICATIONS (COMMUNICATIONS FROM BOARD) President Peeler asked if the Federal Budget situation will impact the City. Jill Kovacs responded that the uncertainty regarding the possible Federal Government shut down would have little direct impact on the City. 8. CIVIL SERVICE BOARD COMMUNICATIONS (COMMUNICATIONS FROM STAFF) Chris Low provided an update on the City Manager hiring process. The recruitment was opened in January and approximately 68 applications were received. Six interviews were conducted in mid-February. On March 25, three finalists were interviewed by a community member panel, a department head panel, and a bargaining unit panel. These panels provided feedback to the Council. LIST OF SPECIFICATIONS Existing Classification Specification Revision: Planner I Planner Il Member Batchelor asked that item 4-D be removed from the Consent Calendar and moved approval of the remainder of the Consent Calendar. Member McHugh seconded the motion which passed 3 - 0. Member Batchelor asked why the requirement for a California Drivers' License was permissive for the classifications of Planner I and Planner II. Ms. Kovacs responded that not all positions in these classifications will be required to drive and leaving it this way provides the City more flexibility. Member Batchelor stated that he understood the Planner I may only be at the counter, but that he thought the Planner Il would be required to go out in the field and would need the license. Ms. Kovacs explained that this was generally true; however the City has traditionally used this language for flexibility as not all the Planner Il's will work in the field. Executive Secretary Willis stated that if we were a larger organization, we could have the more restrictive language. However, because we are small, we would like to have the flexibility to utilize Planner I or Planner Il classifications for field work as needed. Member Batchelor stated that he understood the rationale and was fine with the language as written. Linda McHugh moved to accept the Planner I and Planner Il classification revisions. Executive Secretary Willis pointed out that these requests to the Board are unusual. Margaret Kavanaugh-Lynch, Planning Services Manager gave some of the history surrounding these employees taking on this higher level of responsibility prior to her arrival at the City. She stated that this level of work is necessary for the department. Member McHugh asked if they had taken on the extra responsibilities after the last downsizing was conducted. Ms. Kovacs stated that once the work picked up after the reduction in force these employees began performing journey level work which is commensurate with the Planner II classification. Member McHugh asked if the Planner I vacancies would be filled. Executive Secretary Willis stated that those positions are just replacing the Planner I positions and there is no change in the number of positions. Member Batchelor asked about the compensation of these positions. Executive Secretary Willis stated that these employees have been receiving a temporary pay increase for this work, but the City would like to have the employees placed in the appropriate classification. Executive Secretary Willis responded that employees were generally stressed due to the current layoffs, that notices were going out the next day, and that approximately 10 employees would be laid off depending on how many employees exercised their bumping rights. The City is hopeful the other bargaining units will agree to some cost sharing in the future as well. 8. CIVIL SERVICE BOARD COMMUNICATIONS (COMMUNICATIONS FROM STAFF) Executive Secretary Willis reminded the Board of the special hearing on July 28, 2011. She handed out the procedures used the last time the Board conducted one of these hearings and explained that the Board would have legal counsel to advise them during the process. She stated that it has been several years since a hearing has been conducted and that the Board would receive a briefing before the hearing at 6:30 p.m. The hearing is scheduled as a closed session and will be in Conference Room 360. The appellant has the option of having the hearing in an open session. Some discussion ensued on the process and the fact that a court reporter would be used for the hearing and whether or not the Board would receive anything in advance of the hearing. Vice President Horikoshi stated that he and Member McHugh were reappointed to the Board in action taken at last night's City Council meeting. There was discussion that the next meeting of the Civil Service Board will be held on Wednesday, October 12, 2011 beginning at 5:00 p.m due to the fact that Executive Secretary Willis will be on vacation the first week in October. 9. MINUTES: There were no minutes for approval. 4. REGULAR AGENDA ITEMS 4-A. Presentation to the Board by Legal Counsel regarding Disciplinary Appeal hearing Procedures Mr. Craig Judson, legal counsel to the Board stated that were two items he would cover. One is a procedural issue regarding the absence of a member of the Board and whether or not the hearing will go forward. He said that this would be covered when all of the parties are present. The second is a briefing on the disciplinary appeal hearing procedures. Mr. Judson explained that the hearing scheduled before the Board is an appeal of disciplinary action taken and that this hearing is all about due process. In accordance with state and federal law, due process requires a fair and impartial hearing from a process standpoint. The Board is serving in a Judicial/Appellant capacity and its role is to be fair and open-minded. The overriding issue with due process is to have hearing procedures that are fair and consistent. He explained that this means that everyone should have the opportunity to be heard and to be able to offer rebuttal to any evidence presented. Mr. Judson then explained how important the issue of confidentiality is with these hearings. He told the Board that there were two primary individuals involved with this issue and protecting their confidentiality is paramount. He stated that the hearing will be closed unless the appellant has requested the hearing to be open. He stated that the briefs would provide the Board with background information and a preview of arguments and evidence that would be presented. Mr. Judson then went over the hearing procedures handout. He stated that each side has the option for an opening statement if they choose. He stated that the City would present its case first and present any witness testimony. With each witness there would be an opportunity for each side to cross-examine the witness followed by questions from the Board, if any. Then the City would be able to redirect. It is not rebuttal as shown on the handout. This is followed by the Appellant's re-cross examination. A redirect follows the scope of the prior re-cross examination. New issues cannot be brought up while under re-cross examination. This process can go multiple rounds. Mr. Judson explained that after that process is concluded then the Appellant makes their presentation and the process repeats itself. At the end, there is an opportunity for the City to offer any rebuttal to the Appellant's case. This is the time for the City to re-butt any facts or evidence presented by the Appellant. Then the same process is followed for re-cross examination, redirect, and re-cross as appropriate until the closing arguments. Mr. Judson explained that the closing arguments are like the opening statements in that there is no obligation to present a closing argument. The opening statement is a preview of the evidence to be presented and the closing argument summarizes what the evidence showed. A copy of the revised Civil Service Board Hearing Procedures is attached to these minutes. Mr. Judson then addressed the procedural issue regarding having an even number of Board members to hear the appeal. Public Employee Discipline/Dismissal/Release Hearing (Gov. Code 54957) Joe Wiley addressed the Board and asked for a continuation of the hearing until such time as all five members of the Board could be present. Mr. Wiley explained that should the Board end in a 2 - 2 tie, then the appellant would be entitled to a new hearing. He stated that this would be rather costly for the City and was asking for the Board's consideration of this matter. Mr. Wiley stated that he had discussed this action with the appellant's legal counsel, Ms. Desiree Cox and she concurred. Ms. Cox addressed the Board to reiterate what Mr. Wiley had said and to let the Board know that she was in agreement. Discussion ensued on how to ensure that all five members of the Board would commit to a date and time certain for the continuation hearing date. The Board members present and the respective parties provided dates to Executive Secretary Willis so that she could get a commitment from the absent Board member. Mr. Judson asked if the appellant understood and could acknowledge that he was in agreement to postpone the hearing until all five Board members could be present and that this would not prejudice his appeal. He expressed concern that this Senior Management Analyst position was being singled out at Alameda Municipal Power (AMP) and wanted to understand the implications of this action on the other Senior Management Analyst positions and on bumping rights. Executive Secretary Willis explained that the Senior Management Analyst classification was the top of the analyst series and that at this level many positions have become increasingly specialized and there is a need to have the job specifications match the work and skill set necessary for the job. She further explained that this was not just a title change but was a new classification that, if approved by the Civil Service Board, would need to go before City Council for a salary range which will remain at the same level of the Senior Management Analyst. It no longer falls under the generic, Senior Management Analyst classification. The level of work is more specialized at the Senior Management Analyst level and someone bumping across this level would not necessarily be able to perform the work required by the position they are bumping into. Member McHugh expressed her own concerns with the equity issue, as there had been previous situations where problems and confusion arose with regard to positions at the Golf Course and Public Works. She stated that if there is a need to create another progression to change the Senior Management Analyst positions over time, the Board would feel more comfortable if there were a list of priorities as to how these will be presented to the Civil Service Board. Discussion ensued regarding how many Senior Management Analyst positions would be presented in the future. Executive Secretary Willis stated that she would look at trying to put a list together after talking with the Assistant City Manager. After a bit more discussion, Member Batchelor indicated that he was okay with leaving the job description the way it is. CIVIL SERVICE BOARD COMMUNICATIONS (COMMUNICATIONS FROM STAFF) Senior Management Analyst Kovacs introduced new Human Resources Director and Civil Service Board Executive Secretary, Holly Brock-Cohn. Brock-Cohn spoke about her past experience, all within the public sector, as either a City employee or an independent contractor/consultant. She started her career 25-30 years ago with the City of Burbank, then moved up to the Bay Area and went to work for the Town of Danville. From there she went to Antioch, then Hayward, and most recently was with the City of Livermore. Senior Management Analyst Kovacs alerted the Board that there was another round of layoffs due to the transfer of the City's Animal Shelter to the non-profit group FAAS (Friends of the Alameda Animal Shelter). There were 5 full-time employees affected; 2 were able to keep jobs, one by bumping into a vacant position at the Police Department and the other by bumping into a position at the Public Works Department recently vacated due to promotion of the incumbent to a position at the Housing Authority. Member McHugh asked for clarification in that the position seems to be moving from a working supervisor role to a straight management role. Senior Management Analyst Kovacs stated that at one time there was an accounting manager position which was replaced with two supervising accountants. There has only been one supervising accountant for quite some time. The functions of the position are not changing, but the title is more accurately reflecting what the position has and will be doing. The incumbent is in the process of retiring and a replacement has been hired. The Controller feels that this change more accurately reflects the role of the position. Vice President Horikoshi clarified that it was strictly a change in title. Senior Management Analyst Kovacs stated yes. Member McHugh stated that it seemed the position will be spending more time managing and not doing active accounting. Senior Management Analyst Kovacs stated the position is doing both. Some lower level positions were eliminated and this higher level position is being created to reflect the changing needs of the department to be self-funding. Discussion of the City's New Sunshine Ordinance. Executive Secretary Brock-Cohn provided the Board with copies of the City's new Sunshine Ordinance. These new requirements will need to be adhered too when holding meetings. One of the requirements is that whoever serves on a board/commission where the ordinance involves them, needs to attend training and sign an affidavit. At the next Civil Service Board meeting in July there will be a video training for the Board. Senior Management Analyst Kovacs provided the Board with copies of the full ordinance and a copy of a brochure being distributed to the public. Member representatives from each side can weigh in. He proposed that the Appellant side have ten minutes, the City have ten minutes and then three minutes for each of the Appellants. Mr. Riddle stated that the City recently instituted the Sunshine Ordinance. One of the provisions provides that for any item on the agenda, at the same time that the agenda is provided, all documents given to the Board should also be made available to the public. The ordinance is still in the process of being implemented and staff is still coming up to speed on the issue. In this case, given the appellant process that is involved, that has not happened. If anyone has an objection regarding documents given to the Board in less than the seven days required they should raise their hand now, in which case it would be Mr. Riddle's recommendation to the Board to continue this matter to such a time as seven days have passed to review the documents. If there is not an objection, Mr. Riddle would view this issue as the Board can proceed to hear the appeal. Mr. Gossman stated that the Union has documentation for the Board to review. The Union had previously contacted the Human Resources Department and requested information and also listed some concerns that they have regarding the testing. As of today, the Union has not received any written response from the City. There are eight questions, requests for information from the City. Mr. Gossman has received three answers; test scores, how long the list would stay open, and the rankings of the list. There is some information, he still has not received from the City regarding the request from over three weeks ago. Mr. Riddle stated that if Mr. Gossman would like to explain that information to the Board and if the Board believes that he should have that information and that they (Board) would like to have that information, then the Board can make that decision. Mr. Riddle agreed they would have a full 10 minutes between all of them to begin. Mr. Gossman provided a six-page document/report (with attachments) to the Civil Service Board. Mr. Gossman stated that he was at the meeting today to represent three appellants who were former employees of the City of Alameda and that they have been program park coordinators for 10 to 11 years working for the City. In March 2012, they were informed that the City was planning to eliminate their positions. At that time there were four positions occupied. They were advised that the Alameda Recreation and Park Department (ARPD) would be eliminating the Park Program Coordinator to create a new classification of Recreational Program Specialist and that one of the four would be laid off because there would be four positions cut down to three. Mr. Gossman also stated that the resolution was taken to City Council and it was stated that this was going to save $400,000 for the City by going to this new classification. In essence, that is a false smoke screen because these employees were already being paid out of the Athletic Trust Fund and not paid out of the General Fund. The fact that they were changing to a new position had nothing to do with the $400,000. But, when we went to a union meeting, a meet and confer, the reason for the new classification was to save $400,000. In essence, we had employees who did not have any fairness or equity in going through the testing processing. After the oral interviews a manager who sat on the board, came up to the employee and stated, "You know what, I was just a pawn. I had no input into the selection process. It was out of my hands." Mr. Gossman concluded that this has been documented in the information provided to the Board. Mr. Riddle asked if Mr. Gossman was referring to the letter and there was also something called an appeal. Mr. Gossman stated that first of all this is an appeal. They have an appeal. Mr. Riddle asked if this was the initial letter. Mr. Gossman stated yes. Mr. Gossman stated that right after the examination the employees were told that one of the examining people had no part of it. Within two days, they were called into the office and told they were laid off. The employees asked for their test scores. They were told they did not have test scores and that they just did not pass. So they walked out the door after a combined 30 years of experience. The employees are very upset and angry because of the testing process. They all realize that everyone has to take the test and they were looking for fairness. In this testing process and whole examination, it did not happen in this case. The appellants are requesting that the test be vacated, that a new testing process be completed and that it be completed from outside Human Resources personnel, from another agency so that the test can be done fairly and correctly. They were expecting that one person would be laid off and there were three people laid off. One of the new persons hired was an individual who was a custodian in the Library. She really feels that this was an unfair process. She worked with the union for many years and worked to get the union in the City. Most of the time when they have to do budget cuts, they usually do layoffs and most of the time it has been by seniority. This was not by seniority. The primary difference between the two levels is that the Recreation Service Specialist is going to be a much more responsible position for creating and evaluating programs so that the programs created are much more cost recovering then they are today. As indicated in the staff report, ARPD/City is trying to move ARPD towards a model of maximum cost recovery of which the goal is initially 60% cost recovery. There are many other recreation and park departments that get a much higher cost recovery, closer to 90%. In these lean times when the economy and the State are taking away a lot of our monies we must be much more creative with regard to delivering those recreation programs that are valued by the citizens on a cost recovery basis. Member Batchelor asked if there was talk at any time to look at the four candidates and make it promotional within their department. Mr. Low stated unfortunately Human Resources is not able to do that. Other Departments have expressed the same desire to limit the applicant pool to employees within their departments, but the way Human Resources has received feedback and instruction from the Board, in terms of implementing the civil service system here, is that whether it be on a promotional or open competitive basis you want to be as inclusive on a promotional basis to those who have worked here in a regular position for at least six months to be able to promote. LIST OF SPECIFICATIONS Existing Classification Specification Revision: City Planner (New Class) Deputy City Clerk (Redline) Senior Fire Code Compliance Officer (New Class) Supervising Librarian (Redline) Member Malloy asked that the City Planner Classification be removed from the Consent Calendar for further clarification and asked for the history of the new classification for the City Planner. HR Director Brock-Cohn stated that this was a new classification approved by Council for the new budget. Council approved work force changes and that was the purpose of the new classification. There have been a lot of elimination and readjusting of positions. This was a new classification requested to help them better manage the functions of the Community Development Department. Member Malloy stated she wanted to get a sense of what people, who work for the city, would be potential candidates. Brock Cohn stated that she would have to go back and check. She believes that anybody who is currently a planner would be eligible, or most likely would qualify. But, she needs to confirm and get back to the Board. Vice President Horikoshi asked in which department that the position was located. HR Director Brock-Cohn stated it is still part of Community Development. Member Malloy clarified that the position was not in the zoning area. HR Director Brock-Cohn stated that it is in the Community Development Department. The department has had a number of changes and has eliminated some positions. Also, there were some higher level positions that were eliminated. The City Planner position is actually a lower level which saves them money. Member Malloy stated that it states it is administration and management of all city planning, so it makes her think that it is being done in a variety of locations and this is an attempt to centralize. Generally, any new positions are created, authorized, along with funding by the City Council. That is not under the Civil Service Board's purview. HR Director Brock-Cohn will need to research and confirm. Member McHugh stated that makes sense when it is a completely new position, but when they are sort of getting rid of positions and replacing them with others it does not feel like the same situation. Member Malloy asked how the Board knows that they are new to the City. We (Board) are trying to get more information on the two roles. We appreciate that they create the positions and decide that it is needed and then it is the Civil Service Board's role to make sure that within the civil service rules interests are protected. Member McHugh stated the Board wants to be consistent and in compliance with the rules. HR Director Brock-Cohn will do more research and bring a response back to the Board at their next meeting. 5. REGULAR AGENDA ITEMS 5-A. Activity Report - Period of March 1, 2012 through May 31, 2012. Civil Service Board reviewed the Activity Report for March 1, 2012 through May 31, 2012. Member Malloy asked for clarification on the Separations. HR Director Brock-Cohn stated that the Separations were resignations. The separation from AMP was to go to another job and for the Library it was for personal reasons. President Peeler asked for a motion to approve the Activity Report. Assistant City Attorney Il Sierra began the meeting stating that a special meeting was called to clarify and discuss the roles and responsibilities of various Boards and Commissions. There have been questions regarding the parameters of the Civil Service Board and the appropriate role of a Board Member under the Civil Service system. Assistant City Attorney II Sierra distributed materials (Civil Service Rules, City Charter and Civil Service Board Ordinance 3011). Ms. Sierra stated that the Civil Service System came about when President Garfield was assassinated by somebody who was angry because they could not acquire employment. In turn the Vice President at that time, who became President Arthur, put the Civil Service System in place by creating the merit system. The role of the Civil Service Board is to ensure a fair process and to safeguard the merit system. The Charter and the Ordinances are to support the Board in safeguarding the Civil Service Board Rules within the City of Alameda. City Charter Article 13 states that each Board member is responsible to the City Council for establishing, reviewing the policies of the Civil Service System and making recommendations. Each member is part of a Policy body, just as much as the City Council and the Mayor who direct policy and direct the City Manager to administer those policies. City Charter Article 7, the City Manager's role, explains that just like the Human Resources Director's role is to administer and execute policies and undertakings formulated by the CSB, the City Manager administers and executes policies formulated by the City Council. The City Manager's job is to also appoint, discipline and remove officers and employees of the City and she/he is the sole person responsible for appointing people through the Civil Service System who will carry out those duties. City Charter Article 13 states that the Civil Service System shall be established by ordinance. There are two ordinances that discuss the Civil Service System (Ordinance 3011 and Ordinance 2130) where the purpose and responsibilities of the Board are outlined. Ordinance 3011, talks about the role of Human Resources staff and the Human Resources Director within Section 6 and 7. The responsibilities listed within Section 7 are the job of the Human Resources Department: Preparation of the classification plan, reclassification, class specification, review of employment standards and qualifications. The Board's job is to ensure that the Civil Service system is a good and fair system. The Board has the power to look at those rules and look at those policies and make sure that nothing is going amiss. For example, if a classification is so narrowly written, you as a Board member can say "no, you can't do that. That is too specific." The Board's job is to ensure that it is a fair system and is broadly tailored to attract quality applicants that will fit the needs of the job. City Council's role, according to the Charter is to establish and abolish offices and positions of employment and fix compensation. President Peeler stated that during her commission term in Berkeley, the Board was given a choice to either hear the case themselves or have the case be heard by an attorney, but with the City of Alameda the Board has an attorney as an advisor. Assistant City Attorney Il Sierra stated that the Board may be faced with questions of evidence; the Board is not a governing body of administrative procedures; the Board is free to accept any form of evidence presented. If someone presents the Board with hearsay, they can hear it if they wish. The City Attorney's job is to ensure that the Board takes action according to their limited roles and responsibilities of hearing and weighing all information. Another responsibility of the Board's advisor is to ensure that all confidential matters that need not be discussed with the Board in a public forum be immediately stopped. One of Ms. Malloy's concerns was to have the Board meet with Council prior to the meeting regarding reviewing the position listings presented. Human Resources Director Brock-Cohn clarified that things of this matter should go to Council first as it is under their purview and responsibilities to handle and manage positions/classifications issued, expired or extended. The Board is allowed to look at the job specs, and the positions are to be presented to Council just to ensure that nothing violates the rules, and not to make recommendations on the subject matter at hand. Vice President Horikoshi asked about Board communications, specifically written communication between Board Members and staff. For example, scheduling of meetings and who is available. It is his understanding that Board Members are not to "reply to all" with other Board Members within a media of communication, whatever that may be. Assistant City Attorney Il Sierra stated that the Board is not allowed to conduct chain meetings without notifying the public, as this will be a direct violation of the Brown Act. A staff member is allowed to communicate with each Board member to coordinate his/her attendance to a meeting. Questions regarding meeting notes and agendas or concerns should not be communicated through email or with staff members as this is a violation of the Brown Act, falling under being categorized as a chain meeting. Then the Appellant's will have ten-minutes to speak and the public with be able to make comments. Comments from the public will be allowed three minutes per speaker. President Peeler invited Ms. Kramer to present her report to the Board. Ms. Kramer stated that she had been asked to conduct the fact-finding investigation for the Recreation Services Specialist Recruitment and she had concluded her investigation on August 13, 2012. As stated in the report, there is no evidence suggesting that racial discrimination played a role in the recruitment or selection process. Ms. Kramer stated that the Appellants do agree on this finding. Ms. Kramer also stated that as far as the fairness of the recruitment process is concerned, whether Dale Lillard, then ARPD Director, had a predisposed plan to have his candidates selected, or that he in any way influenced the outcome of the recruitment there was no evidence indicating that the selection process was conducted in a biased or unfair manner. The facts that were presented to Ms. Kramer did not corroborate with any of the allegations. Ms. Kramer found that there were three parts to the recruitment process. The first part was a written application in which all of the minimum qualifications were met by all of the applicants and to which the Appellants did not object. There were two issues that were raised; 1) one applicant not having a degree and; 2) another applicant not having enough number of years of experience required. Both allegations were also not corroborated and unsubstantiated. The second part of the recruitment process involved the supplemental questions. During the interviews, Appellants did acknowledge that there were no objections to the supplemental questions. These questions were prepared by Chris Low, HR Management Analyst. The questions were reviewed by Mr. Lillard, but no changes were made to the questions prepared by Mr. Low. Completed supplemental questions were reviewed by subject matter experts who were recommended by Mr. Lillard. Neither of the subject matter experts communicated with Mr. Lillard regarding the questions. There was no indication that he in any way had impacted the evaluation of the responses to the questions. The ranking would not have changed whether or not it was 40-60 or 50-50. The top three applicants were selected based upon the scoring conducted by Chris Low. None of the applicants objected. Also, there was no indication that Chris Low was biased in the selection of candidates. There were several comments attributed to Dale Lillard, where one of the Appellants believes that there was bias in the recruitment process, that the selection of applicants was a "done deal," these comments were not corroborated. Recreation Supervisor Patrick Russi denied making comments attributed to him about being a pawn in the process. Based on her investigation Ms. Kramer concluded that the recruitment was a fair process, Mr. Lillard's involvement was very limited, and did not impact the final outcome of the recruitment. President Peeler thanked Ms. Kramer and asked Board Members for any questions. Member Malloy stated that Ms. Kramer had mentioned on a number of occasions that information was not corroborated. Ms. Kramer believed the person that comments had been made. Ms. Kramer further explained that she did not feel that anyone was intentionally deceitful. She thinks that it was more of a perception issue. President Peeler invited the Appellants an opportunity to address the report presented. Dave Gossman, Business Union Representative for Operating Engineers Local 3 for Alameda City Employee Association (ACEA), stated that he is representing not only the Appellants but all union members applying to the City of Alameda. He did find that the investigation was thorough and complete and stated that there were facts brought up in the report that the Appellants were not aware of and that there were also facts which show that the examination should be overturned. Mr. Gossman stated that the third issue was that there was no notice to applicants on how the grading process would be conducted. The candidates did not know that the supplemental examination was to be weighed and how much the oral examination would be weighed or that it was unknown. Mr. Gossman continued to compare the bulletins published by the Human Resources Department pointing out the weighing of the examination for the Senior Civil Engineer is clear and that the interview weighed as 100% versus the bulletin for the Recreation Services Specialist. Typically, jurisdictions utilize supplemental questions to reduce the size of the applicants. Supplemental questions, typically, are not used to score the application. Mr. Gossman stated that another issue was why there were two panels interviewing for a promotional position. Also, the supplement questionnaire clearly and in bold black print dictated the examiner was to score the answer in the following scoring method: 0 - to indicate no experience, 1-4 to indicate minimal experience, 5-7 to indicate moderate experience, or 8-10 for extensive/quality experience. Ms. Blumkin clearly answered the questions and received no credit, pointing to Addendum #3 in the report he had provided. This is clear evidence that shows one of the raters failed to follow the scoring matrix resulting in an inaccurate score for Ms. Blumkin. Member Malloy asked Ms. Kramer whether or not she thought the selection process was fair in light of a scorer excluding scores in entire categories. Ms, Kramer replied that the process was fair due to that there was no intent and likely just an oversight and/or mathematical error. Management Analyst Low stated that the difference would be that Mr. Wong would have 72.6 points and Mr. McDaniel's would have 72.2 points. This results in Mr. Wong increasing by 1.2 points, or .40 more than Mr. McDaniel on the published list. Mr. Gossman stated the issue now is that the scoring was inaccurate. His recommendation is to have a new test for fairness and equality. Ms. Kramer stated that the important point from her perspective was that with the scoring of the supplemental questions there appeared to be some comment about applicants not being evaluated properly because they did have certain experience that was reflected on their applications. He stated that he has a problem with someone getting a zero for experience that has 15-18 years of experience. How can that be rated a zero. He does not care if someone does not like them or not, the experience counts for what it is. A person who has been running the adult program for 18 years and she got a zero is not right. Ms. Kramer stated that what the raters relied upon was the actual response to the supplemental questions, by giving a zero it was their perception that the response to the supplemental questions did not evidence any experience. Vice President Horikoshi asked Mr. Riddle what the options were for the Board. Mr. Riddle stated that there are three different Appellants. The Board has three different appeals; 1) at one point all three wanted the process to be redone; 2) to have an investigation which has now happened; and, 3) to have the testing done over again and Mr. Wong is now, based on the arithmetic, the third highest person. Mr. Riddle stated that the Board can; 1) deny the appeal based on the investigation and the findings; 2) based on the arithmetical mistake; grant Mr. Wong's appeal in which case he would be considered the third ranked person. Again it is rule of the list, so there is no guarantee that he would have been picked; and, 3) grant the appeal for all three Appellants and direct that a new examination be given. President Peeler asked how the rule of the list is usually applied. Management Analyst Low stated that once an eligible list has been established the number of names certified to the hiring authority is based upon the civil service rules. The appointing authority has the ability to choose any of the names regardless of how they scored on the eligible list. There have been incidents where higher scoring candidates have been passed over for promotion and were not selected for a variety of legitimate reasons. His understanding is that if there is not a motion to grant any of the three appeals, the effect of that is to deny the appeal. President Peeler asked based on the City saying that the top three were chosen and Mr. Wong is now in the top three can the Board move that he be appointed to the position. City Attorney Kern stated that what is before the Board is whether or not the processes were fair, not who should get the job. The Board is deciding if the process was fair. It is not the Board's decision on who should get the job. Member McHugh moved that the Board grant the request of the Appellants, not for all of the reasons given, but as to what was brought out in Ms. Kramer's investigation; there was a need to rush, mistakes were made, lack of deciding what the rating criteria would be in advance, and announcing the job posting. Laurie Taylor, Community Development Director, was at the meeting to answer any questions of the Board. Ms. Taylor oversees three divisions (Economic Development, Building, and Planning which includes Code Enforcement). In Planning, there were two Planning Services Managers which were equal. One handled advanced planning, one handled current planning. Current planning is when someone comes in at the counter and pulls permits, etc. The Department was reorganized so that there would be a City Planner position slightly higher than the Planning Services Managers so that all divisions would have a division head similar to the building official or economic development manager for consistency. This was to streamline operations. Member Malloy asked if it now is a City Planner above the current people applying for permits, etc. Director Taylor stated no, it is one City Planner - a division head for all of planning. They oversee advance planning and current planning. Personnel Management Analyst Kovacs stated that this was one part of a departmental reorganization. There were a total of approximately nine positions involved in the total reorganization which involved developing a new classification. The reorganization of the department and addition of the position has already been approved. A list could have started in January, but a name may not have been put on the list until October. The name would have two years from October on that list. The Academy lasts six months and they will complete it in March 2013. Member McHugh asked if it was normal for them to wait almost two months before they start the Police Academy. Chief Noonan stated no. There are people there that if they are qualified, he may recruit them. Everyone is looking for quality police officers. Member Malloy asked how likely it is that these three people could jump into some other jurisdiction to find work and be hired as employees before December 31st. Chief Noonan stated that it is quite good, very likely. Because every city has different hiring processes and if they are in the Academy they are considered an Academy grad technically. Other cities can expedite the testing process. A perfect example is that Fremont, Union City, Newark, and Oakland put their people through as police officers. Personnel Management Analyst Low stated that an Assistant City Attorney II can have a wide variety of legal responsibilities that are assigned. As an example, Assistant City Attorney II Stephanie Sierra was hired from the list but she is not an expert in every aspect of municipal law. The current vacancy is more of a litigating attorney. There were some litigating attorneys on the list but who have subsequently taken other positions. Other qualified candidates could do this level of work, but were not litigators, and do not meet the needs of the city any longer. The City Attorney has indicated that the current eligible list does not meet the business needs of her office or the city. Therefore, she is recommending to cancel the current Eligible List and go back out to get an attorney that does meet their needs. Director Brock stated no, the pension reform does not impact current/classic employees. This is one of the general classification positions being looked at where the position has evolved into a more specialized position. Vice President Horikoshi asked in what other departments are there Administrative Services Coordinators. Senior Management Analyst Kovacs stated they are in AMP and Community Development. There are not many left. Member McHugh asked if the technical knowledge and skills that are required for the positions being separated out are all very different between the departments. For instance, the Library Circulation Coordinator specification, under employment standards and experience, they are looking for the knowledge and ability to deal with the Library environment and technology. Member McHugh asked if there is some reason that this position has become so much more technical that the City did not require a two or four year Library of Science Degree. It is in all the Safety MOU's. Only Chief of Police and entry Police Officer will go outside. Vice President Horikoshi asked if there was a Street Sweeper Operator who does not work early morning shift. Senior Management Analyst Kovacs stated yes. The other people who operate the street sweepers are Maintenance Worker Il's and it is more of an intermittent part of their job. In the past the Early Morning Street Sweeper Operator has been paid with a differential, but the Public Works Director determined that the best way to handle the situation was to have a designated classification for the position and the differential is included in the salary. President Peeler stated that it seems they would not need supervision as much. Senior Management Analyst Kovacs stated that is correct, but that does not mean that a supervisor would not on occasion show up. She also asked if the process for this is basically looking at the incumbent's current duties or were there additional duties listed for what the needs of that position might be in the future. Acting Human Resources Director Kovacs stated that whenever a classification and the corresponding job specification is developed, the intent is that it is fluid and flexible, so that the job specification does not have to be reviewed and reapproved by the Civil Service Board every few months. Acting Human Resources Director Kovacs further stated that this is why job specifications say "Example of Duties." An incumbent might not necessarily perform every single duty that is listed in the specification at a given time. However, operational needs and employee duties may change in the department and the job specification is designed to accommodate such shifts. 5-B. An Eligible List might include individuals who have passed the general qualifications for a classification but did not excel in a particular area of a given position vacancy. In such cases, departments may need a larger list to select from. Member Malloy asked if there were selections made from the list prior to it only having one person on it. Acting Human Resources Director Kovacs stated yes, the list was a promotional list. Originally there were three names on it and two people were selected for other positions. There is one remaining vacant position and the one candidate left on the list was not strong in the particular skill area of the current position vacancy. Member Malloy stated that many times departments just do not want the third or fourth person on a list. So the list is closed early to exclude the person, as opposed to them not having the skill set. Member Malloy asked how much time the employees have to request a hearing on a non-voluntary separation. Acting Human Resources Director Kovacs stated that if it is a layoff they do not get a hearing. She believes that on a non-voluntary separation it would be 90 days, but will need to clarify. Both lists were cancelled on the same day they were established. Acting Human Resources Director Kovacs stated that these lists each had one candidate. Senior Human Resources Analyst Low stated that for both jobs there was only one candidate placed on the eligible list for each position. Both were offered appointment and both accepted. As a result, each eligible list was exhausted on the same day it was established. Vice President Batchelor asked if the City was satisfied with these positions being offered for that short of time. Senior Human Resources Analyst Low stated that the candidates were in-house and that internal promotional exams were conducted. Acting Human Resources Director Kovacs advised the Board that when there is a "PR" after the exam number that means it is a promotional recruitment. Vice President Batchelor asked if the IBEW will be agreeable with the Line Working Supervisor job specification revision to duty #6 (assists in the supervision, training and evaluation of assigned staff). Senior Human Resources Analyst Low stated that the description was vetted to the IBEW and they agreed. Acting Human Resources Director Kovacs stated there were changes to the previously provided Substation and Meter Supervisor specification and provided the Board with a memo from Senior Human Resources Analyst Low describing the changes. Member McHugh asked if both the Line Working Supervisor and the Substation Meter Supervisor classifications were non-exempt.
