REGULAR AGENDA ITEMS 4-A Review of Classification Process. Discussion: Staff presented to the Board a report regarding Alameda Police Officers Association- Non- sworn (PANS) December 28, 2003 - December 24, 2006 MOU Implementation, Classification/ Step Reassignment of incumbent employees. The report was comprised of a list of incumbent PANS members involved in the December 26, 2004 classification reassignment and was provided to the Board as notice of the action for presentation to and affirmation of the Board. Board President Robles-Wong explained that he was surprised by how many employees were affected by the reclassification issue from last meeting. He stated that he would like job title assignments to be confirmed so that there will not be a question years from now that each person who was reclassified has permanent status. Executive Secretary Willis explained that there were no changes in qualifications or salary ranges, and there were no promotions given. Board President Robles-Wong stated that what needed to be clarified was that the position was filled without an exam process, and that it is legitimate because employees were "reassigned". Executive Secretary Willis stated that there is no definition for reassignment under the Civil Service Rules. The individuals were broken out separately into new classes with the same qualifications. On page 4, third paragraph, second line, supplement questionnaire should be changed to supplemental questionnaire. On page 7, fifth paragraph, Mr. Riddler should be changed to Mr. Riddle. On page 9, in bolded paragraph, Motion passed 4-1. It should be noted that the one vote was an abstention and Mr. Horikoshi would like the record to reflect that abstention. President Horikoshi called attention to the memo from the City Manager to the Civil Service Board designating the Human Resources Manager to serve as Acting Human Resources Director and Executive Secretary of the Civil Service Board. The FY 2013/2014 and FY 2014/2015 budget does not include the Human Resources Director position. Jill Kovacs, Acting Human Resources Director, stated that there is no longer a Human Resources Director. Also, eventually there will be a recruitment and appointment to the Human Resources Manager position but until that time; she will be serving as the Interim Human Resource Manager. Member McHugh asked if the Human Resources Director position was eliminated. Acting Human Resources Director Kovacs stated yes the position is eliminated but not the classification. President Horikoshi asked that if sometime in the future they wanted to fund that position they could. Acting Human Resources Director Kovacs stated yes. 2. Member Peeler moved to accept the reinstatement, Member Rocha seconded and carried by a 5-0 vote. 4-B Eligible List History Review Karen Willis explained that the board had requested Human Resources staff to bring back information regarding the Golf and Park Maintenance Worker classification, how the job announcements had been posted, history of the classification, how bumping rights apply, and how or why there is only one seniority list. She then passed out materials related to this issue. Jill Kovacs explained that one of the documents was a general look at the Golf Course as a department and division. She went on to explain dates of when the Golf Course became a division under the direction of the Recreation and Parks Department, and when it finally became its own department. Presentation to the Board by Legal Counsel regarding Disciplinary Appeal hearing Procedures Mr. Craig Judson, legal counsel to the Board stated that were two items he would cover. One is a procedural issue regarding the absence of a member of the Board and whether or not the hearing will go forward. He said that this would be covered when all of the parties are present. The second is a briefing on the disciplinary appeal hearing procedures. Mr. Judson explained that the hearing scheduled before the Board is an appeal of disciplinary action taken and that this hearing is all about due process. In accordance with state and federal law, due process requires a fair and impartial hearing from a process standpoint. The Board is serving in a Judicial/Appellant capacity and its role is to be fair and open-minded. The overriding issue with due process is to have hearing procedures that are fair and consistent. He explained that this means that everyone should have the opportunity to be heard and to be able to offer rebuttal to any evidence presented. Mr. Judson then explained how important the issue of confidentiality is with these hearings. He told the Board that there were two primary individuals involved with this issue and protecting their confidentiality is paramount. There have been questions regarding the parameters of the Civil Service Board and the appropriate role of a Board Member under the Civil Service system. Assistant City Attorney II Sierra distributed materials (Civil Service Rules, City Charter and Civil Service Board Ordinance 3011). Ms. Sierra stated that the Civil Service System came about when President Garfield was assassinated by somebody who was angry because they could not acquire employment. In turn the Vice President at that time, who became President Arthur, put the Civil Service System in place by creating the merit system. The role of the Civil Service Board is to ensure a fair process and to safeguard the merit system. The Charter and the Ordinances are to support the Board in safeguarding the Civil Service Board Rules within the City of Alameda. City Charter Article 13 states that each Board member is responsible to the City Council for establishing, reviewing the policies of the Civil Service System and making recommendations. Board President Rich asked if the City Manager has the ultimate say on the disposition of the grievance. Executive Secretary Willis stated that anything under a 30 day suspension would go directly to the City Manager, and anything over a 30 day suspension could either go to the City Manager or the Civil Service Board. She would like the Ordinance changed to adhere to the Ordinance. The Ordinance needs to be changed so that we are not out of compliance. Director Brock stated that her understanding is that they are viewing it as one time but she will follow-up and confirm with the City Attorney's Office. It was suggested to include an appendix to provide a basic template for items where candidates are requested to submit such as appeals, written applications, waivers, etc. There is a concern that the second sentence may not be following the lay-off provision in the Memorandum of Understanding (MOU) in that it is based on years of service. City Attorney Kern introduced Randy Riddle, outside counsel for the Board, who has been hired to give advice to the Civil Service Board. President Peeler asked Mr. Riddle how to proceed with the meeting. Mr. Riddle stated that he will make a recommendation on how to proceed and if all parties agree the Board can then proceed. Member representatives from each side can weigh in. He proposed that the Appellant side have ten minutes, the City have ten minutes and then three minutes for each of the Appellants. Then three minutes for the City and Appellant representatives to each give additional statements. Dave Gossman, Union representative for Operating Engineers Local 3, agreed to the procedure. Chris Low stated that this is the first time the City has used the new system regarding the continuous postings of police officer positions. Executive Secretary Willis asked if in the future as new names are added, what would the Board see, the entire list or only the newly certified names? Chris Low responded that only the new names would be certified to the Board. Member McHugh stated that she thought this seemed like a good list. Chris Low stated that it is a good list but there are other steps that must be taken such as the background check which may potentially eliminate many of the names. Vice President Horikoshi moved to accept the consent calendar. Member McHugh seconded and the motion passed by a 4-0 vote. 5. REGULAR AGENDA ITEMS 5-A Activity Report Period of September 1, 2009 - November 30, 2009 Executive Secretary Willis explained that she had inadvertently left out the Activity Report from their packet. It was handed out to the Board. Member McHugh asked about the reason for the two separations. Staff responded that one was due to a resignation and the other due to a death. 5-B Civil Service Ordinance Executive Secretary Willis told the Board that the Civil Service Ordinance was passed by Council and had a new number. It has since been placed on the City website. General discussion ensued regarding the process and how long it had taken for this ordinance to be updated. 5-C Update on Reduction-In-Force Executive Secretary Willis updated the Board on the status of the lay-offs at the Golf Complex. She stated that eight employees were separated, one got another job with the City and one decided to retire. There is a job opening with Public Works and the City is hopeful that will result in someone else being able to get a position with the City. Board President Robles-Wong commented that all reassignments should be brought to the Civil Service Board in the Activity Report along with New Hires, Promotions, etc. Member Rich commented that what happened to the employees who were reassigned is not well defined and asked if there was any correspondence to the Unions and Employees. Jill Kovacs shared that a letter was sent out. Member Rich shared that he would prefer to see the word "transfer", clearly defined in the Civil Service Rules, used in place of the word "reassignment". Board President Robles- Wong stated that he would like clarification placed in the personnel files of each employee who was affected by the reclassification that explains the word "reassign" should mean "transfer". Member Rocha made a motion to accept that "reassign" should mean "transfer" under the Civil Service Rules. Member Rich seconded, and carried by a 4-0 vote. 4-B Ordinance Review Discussion: Staff presented CSB Ordinance review notes presented as margin notes on the current Ordinance. Executive Secretary Willis explained that the language changes shown are suggestions from Human Resources. Member Rich stated that some of the Department Head Titles do not exist anymore and that he would prefer to not see them all listed separately, but rather as "all department heads that report to the City Manager". 4-C Rule Change- Article VII, Appointment, Section 1. Certification of Eligibles and Section 2. Method of Appointment. Executive Secretary Willis explained that Firefighter/Paramedic was mistakenly left off of the classifications requiring professional certification or advanced degree. Executive Secretary Willis confirmed that there was a lateral transfer of a Golf employee who transferred to the Recreation and Parks Department. Board Member Rocha asked if there were any documents showing these moves. Executive Secretary Willis stated that for each move there was a Personnel Action Form. Derek Taylor stated that from his perspective the policy was that they were all Golf and Park Maintenance Workers and it was common knowledge that they could be moved from Golf to Parks. Parks employee Dennis Tavares stated that when he was hired his employment papers did not say anything about the Golf Course and that he was hired to work strictly at the baseball facility only. A job announcement for Park Maintenance Worker - Pools was then distributed to the Board. Executive Secretary Willis explained that the Human Resources Department has always had a single classification for the position called Golf and Park Maintenance Worker and that this classification is part of the ACEA MOU, classification 5260. She stated that this is the classification title that goes to the City Council for pay ranges etc., and it is also the title that was brought to the Civil Service Board when the classification was created. She stated that the earliest date they could find as an example of this was 1972. She also stated that during a recruitment, bulletins are sometimes posted with the working title showing where the position is to be assigned. For example, if it were a Golf and Park Maintenance Worker in Parks it would be posted as a Parks Maintenance Worker and vice versa. Mr. Low responded that the weight of the equipment is what determines the class of the driver's license and not necessarily the type of vehicle. Member Batchelor stated that the City may want to review this qualification in light of this job specification to make that determination. Member McHugh pointed out that the job specification calls for routine maintenance and the operation of heavy equipment. He stated that the briefs would provide the Board with background information and a preview of arguments and evidence that would be presented. Mr. Judson then went over the hearing procedures handout. He stated that each side has the option for an opening statement if they choose. He stated that the City would present its case first and present any witness testimony. With each witness there would be an opportunity for each side to cross-examine the witness followed by questions from the Board, if any. Then the City would be able to redirect. It is not rebuttal as shown on the handout. This is followed by the Appellant's re-cross examination. A redirect follows the scope of the prior re-cross examination. New issues cannot be brought up while under re-cross examination. This process can go multiple rounds. Mr. Judson explained that after that process is concluded then the Appellant makes their presentation and the process repeats itself. At the end, there is an opportunity for the City to offer any rebuttal to the Appellant's case. This is the time for the City to re-butt any facts or evidence presented by the Appellant. Then the same process is followed for re-cross examination, redirect, and re-cross as appropriate until the closing arguments. Mr. Judson explained that the closing arguments are like the opening statements in that there is no obligation to present a closing argument. The opening statement is a preview of the evidence to be presented and the closing argument summarizes what the evidence showed. A copy of the revised Civil Service Board Hearing Procedures is attached to these minutes. Mr. Judson then addressed the procedural issue regarding having an even number of Board members to hear the appeal. Jill Kovacs responded that if a new recruitment was opened now for Park Maintenance Worker, we would want park-focused experience. However, it would depend on the strength of the recruitment pool whether someone with other greens or landscaping experience would do well in the recruitment. Should the Golf Course reopen at some point, it would remain to be seen if we would expand this classification or create a second classification. Vice President Horikoshi stated that in terms of the examples of duties, he remembers previous discussions about swimming pools, baseball diamonds and tennis courts. He asked if recruitments tested generally for such position, or if there is a position that is going to work on swimming pools and do we recruit for someone with that kind of experience? Chris Low replied that a Maintenance Worker I recruitment is open now that specifies where that vacancy is and the recruitment is tailored to fill that particular vacancy. CIVIL SERVICE BOARD COMMUNICATIONS (COMMUNICATIONS FROM BOARD) Member Robles-Wong suggested that we add language to the Civil Service Rules under Article VII. Section 1 Establishment of Lists to include National Guard members in our definition of candidates with active military service who are eligible for an award of veteran preference points in our examination scoring process. Language will be revised by staff and presented at the April 2005 Civil Service meeting for approval by the Board. Executive Secretary Willis explained that they are old recruitments which were created under the old process and will eventually fall off. Board President Rich stated that he is aware of the City's budget problems and asked whether the new budget included cuts to positions. Executive Secretary Willis stated that there were some vacant positions that were either unfunded or eliminated, but that they are not tied to the budget because there is no money tied to them. Board President Rich then asked if the City was in a hiring freeze. Executive Secretary Willis explained that the 2008/09 budget passed and because of this the City is able to fill budgeted positions. She also stated that two positions were eliminated that had people in them, and those people then exercised their bumping rights. Because of this, two probationary employees lost their jobs in the budget process. Member Horikoshi moved to accept the consent calendar, Member Peeler seconded and carried by a 4 - 0 vote. 5.
