Ms. Highsmith explained that because the prior hearing to which they were referencing was held as an open session, the witnesses were also members of the public, and could not, therefore, be barred from the proceedings. The Board could ask the witnesses to leave the room while other testimony was being given, but this request could not be enforced. If this were a closed session setting, the witnesses would be sequestered and brought in one at a time for their testimonies. The subject of impartial legal advice arose again, and Ms. Highsmith reiterated the position of the City Attorney's office in that there is no correspondence prior to a hearing between the Board's attorney and the attorney presenting the case against the appellant. Ms. Highsmith also advised the Board on procedures for handling objections. Member Robles-Wong asked that a small change be made to ARTICLE XI. PROCEDURE ON APPEALS under Section 3. NOTICE AND DECISION of the Civil Service Rules which states in part " Within ten (10) days after the hearing is concluded and the matter submitted for decision, the Board shall make its written decision To be more specific, the Board asks this statement be amended to read " Within ten (10) business days. Member Robles Wong made the motion to effect this change; Member Smith seconded and was carried by a 3-0 vote. Staff will follow-up with noticing all appropriate parties and soliciting opinions on the subject. 10. Executive Secretary Willis announced that former CSB Member William Smith had submitted a letter of thanks to her. Executive Secretary Willis stated that in January, new law AB1234 was passed requiring that appointed officials and Board and Commission members who are compensated or reimbursed for expenses are required to attend ethics training once every two years. The training is paid for by the City and is also available online. Notices will be sent out shortly to the members of the Civil Service Board. 9. Pam Sibley stated that, with the bulletins that she worked on, they would pull out the information that applied to that specific position from the job specification. Board Member McHugh asked, when Human Resources negotiates a new contract, how are these issues discussed and if they are discussed at a classification level between the Union and the City. Terry Flippo, Parks employee, stated that in 2001/02 negotiations the separation from the Golf Course came up. He stated that they discussed the different duties of the jobs and that he went out to the Parks Department to see what their maintenance workers were doing and that a Park maintenance worker came to the Golf Course to see what he was doing. He stated that they were told that it was a Civil Service Board issue and it was not to be addressed in negotiations. Alan Elnick confirmed that is indeed what happened and that they could not negotiate that without the approval of the Board, but that it was never taken to the Board. Board President Rich asked if there are any other vacancy's within the City that people might be able to be hired into. Executive Secretary Willis stated that they will try to look at any other vacancies that may come up within the City, but that people being layed-off from the Golf Course would not have the right to bump into those positions. Member Rocha asked if the layoffs were because there were no other positions with the City. Jill Kovacs explained that employees were either directly laid off or bumped out of their positions by employees with more seniority resulting in four Recreation and Park employees being bumped by Golf employees. The remaining Golf employees did not have seniority rights and they were directly laid off. There are exams going on now including Maintenance Worker l at Public Works, and these laid off employees have been invited to apply. President Peeler asked about the special notification list. Jill Kovacs explained that a special list of laid off employees is maintained, including employees who were part of the June 2009 City-wide Reduction in Force (RIF) and those impacted by the Golf layoffs at the end of 2009. AMP employees from an earlier lay off were also on the list, but have now rolled off. The contact list is used to invite and encourage laid off employees to apply for open positions. The June RIF layoff agreement provided that a laid off employee would retain rights to apply for internal promotional exams, or lateral or lower ones, and that the employee would be considered an active employee for the sake of their eligibility to apply. Board members discussed if the internal application was applicable for one or two years. Jill Kovacs confirmed the ability to apply for internal exams for one year and reinstatement rights to a position previously held for two years. President Peeler asked if the gasoline tax situation will create more layoffs. Jill Kovacs responded that there would be no further Golf layoffs because there are no Golf employees remaining. She handed out the procedures used the last time the Board conducted one of these hearings and explained that the Board would have legal counsel to advise them during the process. She stated that it has been several years since a hearing has been conducted and that the Board would receive a briefing before the hearing at 6:30 p.m. The hearing is scheduled as a closed session and will be in Conference Room 360. The appellant has the option of having the hearing in an open session. Some discussion ensued on the process and the fact that a court reporter would be used for the hearing and whether or not the Board would receive anything in advance of the hearing. Vice President Horikoshi stated that he and Member McHugh were reappointed to the Board in action taken at last night's City Council meeting. There was discussion that the next meeting of the Civil Service Board will be held on Wednesday, October 12, 2011 beginning at 5:00 p.m due to the fact that Executive Secretary Willis will be on vacation the first week in October. 9. It no longer falls under the generic, Senior Management Analyst classification. The level of work is more specialized at the Senior Management Analyst level and someone bumping across this level would not necessarily be able to perform the work required by the position they are bumping into. Member McHugh expressed her own concerns with the equity issue, as there had been previous situations where problems and confusion arose with regard to positions at the Golf Course and Public Works. She stated that if there is a need to create another progression to change the Senior Management Analyst positions over time, the Board would feel more comfortable if there were a list of priorities as to how these will be presented to the Civil Service Board. Discussion ensued regarding how many Senior Management Analyst positions would be presented in the future. Executive Secretary Willis stated that she would look at trying to put a list together after talking with the Assistant City Manager. After a bit more discussion, Member Batchelor indicated that he was okay with leaving the job description the way it is. Vice President Horikoshi stated that he understood the issue and the need for special skills. Member McHugh expressed concerns regarding the language on the experience where it says, any combination of education and experience likely to provide" as it seemed vague and subjective. Vice President Horikoshi stated that this was typical language in the public sector and that it provided flexibility for the organizations. Recreation Services Specialist (New Class) Member Malloy asked if this classification will be sandwiched between others or added at the bottom of the list of qualifications for this department. Senior Management Analyst Kovacs stated that this classification is just below the manager classification. Those persons in this classification oversee the day-to-day operations. This item is part of a staffing change recently approved by City Council. Some lower level positions were eliminated and this higher level position is being created to reflect the changing needs of the department to be self-funding. The recruitment has just closed and there will be some positions eliminated and some people may be impacted. Member McHugh asked if this will be like eliminations before with regards to bumping rights, etc. Senior Management Analyst Kovacs stated there will not be any bumping because these individuals do not have any bumping rights. In essence, we had employees who did not have any fairness or equity in going through the testing processing. After the oral interviews a manager who sat on the board, came up to the employee and stated, "You know what, I was just a pawn. I had no input into the selection process. It was out of my hands." Mr. Gossman concluded that this has been documented in the information provided to the Board. Mr. Riddle asked if Mr. Gossman was referring to the letter and there was also something called an appeal. Mr. Gossman stated that first of all this is an appeal. They have an appeal. Mr. Riddle asked if this was the initial letter. Mr. Gossman stated yes. Mr. Gossman stated that right after the examination the employees were told that one of the examining people had no part of it. Within two days, they were called into the office and told they were laid off. The employees asked for their test scores. They were told they did not have test scores and that they just did not pass. So they walked out the door after a combined 30 years of experience. The employees are very upset and angry because of the testing process. They all realize that everyone has to take the test and they were looking for fairness. In this testing process and whole examination, it did not happen in this case. The appellants are requesting that the test be vacated, that a new testing process be completed and that it be completed from outside Human Resources personnel, from another agency so that the test can be done fairly and correctly. They were expecting that one person would be laid off and there were three people laid off. One of the new persons hired was an individual who was a custodian in the Library. In being objective, how could a custodian who works in the Library have more experience or training? In fact, he had no training in the parks recreation programs to be selected. Analyst Low responded security is a responsibility for all members of Info Technology. He indicated this position is responsible for assisting AMP employees with day to day technical issues, best practices, and cyber security. AMP also coordinates with the City's IT department to standardize training. Member Barde stated this seems like a junior position that would not lead the effort to protect against network intrusion. Analyst Low stated security was a team effort and started with the Utility IT Manger position who sets standards for maintaining the various systems and much of the work is a team effort. When it comes to end users taking security seriously, it is this computer services technician that handles that.
