He further explained that he remembers it usually being listed as $0.00. Finance Director Adair explained that the amount shown on the report is due to the timeliness of the transfer of funds into the account. Member Kovacs showed Member Soderlund her copies of prior reports and said that historically, it has not been listed zero. Member Edwards asked Finance Director Adair about the minutes from the last meeting. He asked her to clarify if the audit for this committee will be removed and that it will be incorporated into the annual report for the entire City. He further asked if the City Attorney's Office should be reviewing the Ordinances in order to fulfill the Pension Board's obligations. Finance Director Adair responded that is not the case. She explained that the City wide audit already includes a review of the funds for the Pension Board. She further explained that, in the past, the City did separate reports for these funds. Upon review of the Ordinances (1079 and 1082), there was no required need to provide separate reports because it is already incorporated into the CAFR financial statements that is provided to the entire City. She further explained that the quarterly and annual reports will still come to the Board. Member Soderlund stated that the money is coming out of the General Fund. Finance Director Adair replied, yes, the money for pension payments comes from the General Fund. Mayor Herrera Spencer arrived late from another City event. Secretary Kovacs gave the Mayor an update on where the Board was on the Agenda, explaining that since her presence was required to approve the July 25, 2015 Minutes, the Board had deferred action on item 3 until her arrival, and that the Board had discussed item 4, Pension Payroll and Financial Reports. Member Soderlund mentioned that with PERS, there is a 2% adjustment, depending on the 1082 contract at the time. Human Resources Director, Nancy Bronstein asked if the 1079 plan was the earlier plan, in which member Soderlund confirmed the 1082 plan replaced the 1079 plan. Member Edwards also noted the 1079 stopped in 1953. Human Resources Director, Nancy Bronstein understood that those in 1079 retired before the option of switching to PERS and those in 1082 are those who opted not to switch over. Both members, Edwards and Soderlund, confirmed that this information was correct. Member Soderlund explained that initially no money was put into the 1079 plan, then eventually 2% was put in, and then by 1953 4% was put in. Member Soderlund further explained this plan was financially cumbersome for the City and was eventually removed because members in 1079 retired at half pay, but received the same salary for the position they were in full time and their spouses also received the same amount. 7. Member Soderlund and Elzig inquired whether the City pays for the actuarial valuations. Member Soderlund mentioned there was discussion that an actuarial valuation may not need to be done for the Fire and Police Pension and that would save approximately $10,000. Financial Services Manager, Geoffrey Buchheim responded that there was indeed a discussion in the June 2015 Pension Board meeting and the $10,000 was an unnecessary need to do a separate financial report. He continued and said Finance Director, Elena Adair did a presentation showing that a separate annual audit financial report is not necessary for the Pension Funds and would save $10,000. Member Soderlund asked if the actuarial is for the 1079 Pension Fund. Financial Services Manager, Geoffrey Buchheim answered that the actuarial is for both the 1079 and 1082 Pension Plans. He noted there are currently two members in the 1082 Pension Plan and approximately twenty-three (23) members left in the 1079 Pension Plan. Member Soderlund commented that only three firemen are left in the Pension Plans. Member Edwards also mentioned one member recently turned ninety-one years old and is the last member on the 1079 Pension Plan before the 1082 Pension Plan was introduced. Adair also explained there would be adjustment due to late notification of death of 1082 Pensioner, James Isom and his wife. Police Officer Isom passed March 30, 2016, followed by his wife Kathryn on April 27, 2016. Their son is trustee and thought he took care of everything but noticed payments into account. Finance drafted letter to recoup overpayment and working with son has been smooth. Member Elzig expressed sympathy and believed it was easy to overlook things during the circumstances. Member Soderlund asked if uniform allowance is paid every 3 months and Director Adair confirmed it is. Director Bronstein said that in March, the Cost of Living Adjustment will go up which will increase the uniform allowance. Member Soderlund moved to accept the financial statement as presented. Member Elzig seconded. Passed 3-0. 4-B. Copy of Resolution No. 15193 - Determination of Industrial Disability Retirements (IDR). Director Bronstein explained the Pension Board's role for IDR's when questioned or appealed. PERS used to determine IDRs, but in 1999 it went to City Manager who delegated it to Human Resources Director. Human Resources determines decision based on medical information. In case of dispute, employee has options depending on situation. 1. Can go to Workers' Compensation Appeals Board. 2. Appeal hearing through the Administrative Procedures Act with Administrative Law Judge. Member Soderlund asked how Administrative Law Judge is involved in process. Director Bronstein explained that the Administrative Law Judge issues finding and a proposed decision. The Pension Board can then adopt the decision, reject it and decide the matter, or refer it back to the Administrative Law Judge for more information. Trustee Nancy Elzig confirmed it was part of the contract. Adair further explained the finance statement commonly contains the staff report and the attached revenue and expenditures statement. Adair next explained these closed account funds would be used to pay down unfunded liability, as approved by council. At the end of the year, the money accumulated in these funds after pensions are paid are used to pay down the pensions through CalPERS or IRC 115 Trust. Further, Adair stated the financial statements are rolled into the general fund statements due to GASB regulations, where as they had previously been listed as separate funds. Adair continued to explain that the differences in balances between December and June 30th, the end of the fiscal year, would be proposed for appropriation. Mayor asked if these financial statements included anything out of the ordinary. Adair stated nothing was out of the ordinary and that the expense will go down as participants are removed from the rolls. Trustee Elzig stated that the funds had run out of money and it was found necessary to use the general funds. Director Adair indicated it has been paid from the General Fund since her appointment to her position. Chair Ashcraft asked for the difference between 1079 and 1082 pensioners and Trustee Soderlund replied that prior to 1953 they recieved 4% for pensions. After that they went to the 1082 program. Employees at that time had the option to remain in 1082 or switch to PERS. Secretary Bronstein further explained that only a few employees decided to remain in the 1082 program. Chair Ashcraft inquired about finding a Police representative for the Pension Board and Secretary Bronstein indicated she is trying to find one. Secretary Bronstein suggested the bylaws could be reviewed to find an alternative to finding a retired or local police employee. PENSION BOARD COMMUNICATIONS ICOMMUNICATIONS FROM BOARD): Trustee Soderlund asked about finding a police représentative for the board. Chair Aschraft stated she spoke to the City Attorney about the requirement for living in the City and Secretary Bronstein stated she also spoke to the City Attorney. Secretary Bronstein stated the board member did not have to be retired, they could be currently serving, which provided another opportunity to reach out to police to serve on the board. Additionally another retiree was suggested, providing another avenue to fill the position. Chair Ashcraft asked that everyone keep an eye out for other potential members. Secretary Bronstein said we can look at current potential employees to serve. 7. Finance Accountant Li presented the quarterly reports. The total pension expenses for Plan 1079 remained the same in April and May.
