Request is for an amendment to the timing for compliance with Conditions of Approval from "prior to issuance of a building permit" to "prior to the issuance of a temporary certificate of occupancy" The site is located within a C-C-T, Community Commercial - Theater Combining Zoning District. (This item has been withdrawn from the Planning Board agenda and will be heard by the City Council.) Ms. Woodbury noted that this item had been approved by the Planning Board and then appealed to the City Council. The City Council initially denied the appeal, upheld the Planning Board's action, and adopted the same action as did the Planning Board.
