She also\nrequested that the Waterfront Design Guidelines and sustainable ordinances be raised\nto a higher priority. In addition, she asked for an end of calendar year report on the\nprogress of the Work Program.\nPage 1 of 7", "path": "PlanningBoard/2009-07-13.pdf"} {"body": "PlanningBoard", "date": "2009-07-13", "page": 2, "text": "Vice-President Ezzy Ashcraft and Board member Cook seconded these comments.\nBoard member Cook added that the General Plan Land Use element would benefit from\nan inclusion of design concepts for the Northern Waterfront Mixed Use areas.\n6-B\nFuture Agendas\nStaff presented the future agendas for summer/fall.\n6-C Zoning Administrator Report - The Zoning Administrator approved a Use Permit\nfor a legal non-conforming residential use at 2418 Buena Vista Avenue and a Use\nPermit for one year for a car rental business at 1716 Park Street on June 16, 2009.\n7.\nORAL COMMUNICATIONS:\nAnyone may address the Board on a topic not on the agenda under this item by\nsubmitting a speaker's information slip, subject to the 5-minute time limit.\nNone from the public.\nPresident Kohlstrand presented a proclamation honoring Board member McNamara's\ntenure as a Planning Board member and her dedication and distinction in serving the\nCity of Alameda.\n8.\nCONSENT CALENDAR:\nConsent Calendar items are considered routine and will be enacted, approved or\nadopted by one motion unless a request for removal for discussion or\nexplanation is received from the Planning Board or a member of the public by\nsubmitting a speaker slip for that item.\nItems 8A and 8B were moved to the regular calendar.\n8-C Zoning Text Amendment - Applicant - City of Alameda. The City of Alameda\nPlanning Board will be considering and developing a recommendation to the City\nCouncil on a proposed amendment to the City of Alameda off-street parking\nregulations for the Park Street and Webster Street Commercial Districts. The\nproposed amendments establish new minimum and maximum off-street parking\nrequirements and changes to the parking in-lieu fee requirements.\nBoard member Cunningham moved, seconded by Vice-President Ezzy\nAshcraft to move this project to a future date. The motion passed 6-0-0.\n9.\nREGULAR AGENDA ITEMS:\n8-A\nHarbor Bay Business Park Association, Harbor Bay Isle Associates and\nHarbor Bay Entities -- Bay Farm Island (Primarily Harbor Bay Isle) DA89-01. A\nrequest for a Periodic Review of Development Agreement DA89-01, for the\nperiod through April 4, 2009, as required under Zoning Ordinance Section 30-\n95.1. The properties are zoned R-1-PD (One Family Residence/Planned\nDevelopment Zoning District); C-M-PD (Commercial Manufacturing Planned\nDevelopment Zoning District); O (Open Space Zoning District), and R-1-A-H\n(One Family Residence with Special Agricultural and Height Limit Combining\nZoning District). Reidy, Harbor Bay representative, explained the street design and corrected the\nreview period in the resolution to April 4, 2009.\nPresident Kohlstrand closed the public comment period.\nVice-President Ezzy Ashcraft moved, Board member Cunningham seconded the motion\nto approve as amended. Motion passed 6-0-0.\n8-B\nConformance Rezonings - Applicant: City of Alameda:\nPLN09-0110 - 1913 Sherman Street (APN 074-0906-031-08) A rezoning\nof a 1.9 acre property from M-1-PD, Intermediate Industrial (Manufacturing)\nPlanned Development District, to R-2-PD, Two Family Residence Planned\nDevelopment District.\nStaff presented a staff report on the conformance rezonings. Staff requested that only\nthe 1913 Sherman Street project be continued to a later date.\nBoard member Lynch asked for clarification on the nature for the delay. He\nrecommended that the project be moved forward if staff's recommendation will likely not\nchange after one month's continuation.\nVice-President Ezzy Ashcraft asked for clarification on the neighborhood's request for\nany future development on this parcel having access solely from Sherman Street.\nPresident Kohlstrand opened the public comment period.\nD. Freeman, Estuary Park Action Committee member, spoke about the conceptual\ndesign of the proposed Estuary Park and reminded the Planning Board that the change\nin use would increase residential density, making the park's development an even more\npressing necessity.\nJ. Woodard, Estuary Park Action Committee member, urged the City to begin acquiring\nthe park space and start development of financial resources available from philanthropic\nfunding sources.\nK. The Planning Board will elect\na new President and Vice President for the upcoming year, as required by the\nPlanning Board By-Laws.\nPresident Kohlstrand continued this item until a new Planning Board member is\nappointed by the City Council.\nNo motion was passed on this item.\n9-B\nAppeal of Major Design Review Approval - DR07-0046 - 1611 Walnut Street\n- Cheryl Clemans Appellant. Design review approval for a two-story addition\nand remodel to an existing two-story duplex is being appealed to the Planning\nBoard for consideration.\nStaff presented the project.\nBoard member Cook asked for clarification on the location of the proposed decks on the\nrear of the property.\nC. Clemans, appellant, stated her reasons for appealing the design review: a) the\ndistances between the two homes is five feet and the addition is located in the side yard\nsetback, b) the new addition would shade her property and reduce her privacy, c) her\nPage 4 of 7", "path": "PlanningBoard/2009-07-13.pdf"} {"body": "PlanningBoard", "date": "2009-07-13", "page": 5, "text": "property value would be reduced, due to reduced access views of trees and the sky,\nand d) the new addition would increase the volume of residents, resulting in more noise,\nless parking, and less privacy. She recommended that the new addition end flush with\nher home.\nS. Woan, applicant's representative, pointed out that the applicant has made a good\nfaith effort to accommodate the neighbor's requests and has already included design\nchanges. She continued that the applicant has already initiated construction based on\nCity approvals. Changing the design and removing the existing construction to\naccommodate changes, would present a significant financial hardship. She requested\nthat the appeal be denied.\nVice-President Ezzy Ashcraft commented that the proposal would positively impact the\nproperty values of the overall neighborhood and it is unlikely that the addition would\nnegatively impact the appellants property values. She pointed out that while there would\nbe a negligible increase of shading in December, there already is shading that occurs\ntoday. Because the increase of noise or traffic was not raised in the appeal application,\nshe felt that the board could not review this and make a decision on this issue. She\nrecommended denying the appeal.\nBoard member Cook commented that the deck on the second story should be removed\nto ensure privacy for the appellant.\nBoard member Cunningham endorsed removing the deck from the second story to\nensure privacy. He pointed out that the proposed setback can be approved with a\nfinding that is routinely done by staff and the Planning Board. He supports denying the\nappeal, with the condition that the deck on the second story be changed to a window.\nBoard member Autorino seconded previous members, recommended eliminating the\nsecond story deck, and favored denying the appeal.\nPresident Kohlstrand supported the previous comments.\nBoard member Cunningham moved to deny the appeal with the change to the design\nreview approval that the deck be removed, and the French doors be changed to the\nwindows. Board member Lynch seconded the denial of the appeal. Motion passed 6-0-\n0.\n9-C\nUse Permit - PLN09-0199 - Applicant - CONGLOBAL Industries at Encinal\nTerminals - A request to approve an amendment of the existing use permit UP-\n94-\n06 to allow ConGlobal to continue existing operations from September 26, 2009\nthrough August 3, 2010. A rezoning of property\ncurrently occupied by ConGlobal Industries from M-2, General Industrial\n(Manufacturing) District, to M-X Mixed Use Planned Development District to\nconform to the General Plan Mixed Use Designation.\nStaff presented a staff report.\nPresident Kohlstrand opened the public comment period.\nN. Cabral is in opposes the extension of the Use Permit for further trucking operations\nbecause it is a significant negative impact to the neighborhood.\nS. Rickard, supports the rezoning of the property to Mixed Use. He requested that staff\nprovide information on the status of the Tideland Trust portion of the Encinal Terminals\nproperty at the next Planning Board hearing. He also requested that any interim use be\ncarefully examined for compatibility with the area.\nL. Arnerich, commented on the delayed redevelopment of the Northern Waterfront and\nencouraged the Planning Board to approve Use Permits that support businesses and\nproperty owners until the actual redevelopment can take place.\nPresident Kohlstrand closed the public hearing.\nBoard member Autorino stated that he would prefer to move forward on rezoning the\nproperty at this hearing. He is concerned that interim uses would not be compatible with\nthe neighborhood.\nDavid Brandt clarified that the code amendment, as proposed for the next hearing,\nwould address interim uses that could be approved until any Master Plan development\nwould be able to start.\nVice-President Ezzy Ashcraft is concerned about a continuation of any trucking related\nuse permit and its impact on the neighborhood. She asked what conditions could be\nchanged to mitigate and address lack of landscaping, visual blight, trash accumulation\nnoise, and air pollution. She favors granting the extension of the Use Permit for\nConGlobal, but requests that the phasing out of this business is sped up to ease the\nimpact on the neighbors.
