Smith, and Executive\nSecretary Karen Willis.\nABSENT:\nMember Roberto Rocha.\nSTAFF PRESENT: Terri Highsmith, Assistant City Attorney, Donna Mooney, Deputy City Attorney\nand Marsha Merrick, Executive Assistant, Human Resources.\nOTHERS IN ATTENDANCE: Marion Miller, ACEA President, Mary M. Leichliter, Attorney and Mrs.\nGoins, spouse of Dominic Goins.\n3.\nMINUTES:\nThe minutes of the regular meeting of July 13, 2005 were presented for approval. Member\nRich asked that his comment from that meeting be shown in the October 12, 2005 minutes in regards to\ntwo promotional recruitments - Storekeeper and Development Coordinator. Member Rich felt these\nexaminations could have been handled as open/competitive, questioning whether there would have been a\nlarge enough candidate base to choose from within the City. All agencies surveyed continue to use the\nsame method as was in place in mid-2002 when original survey was performed. Member\nRobles-Wong provided explanation to Member Smith on how the rule of 3, 5, 10 and rule\nof the list works.\nMember Robles-Wong would like to see Alameda go to rule of the list at least for all open\nexaminations. Member Rich again expressed reservations to this method, and after some\ndiscussion, put forth an alternative providing that examinations requiring professional\ncertifications might be acceptable. The results were pre-\nand post-rule of the list respectively. It was determined that there was only about a 1-2%\ndifference in ethnicity statistics between the 1999 and 2001 reports, not enough to prove\nthat going to rule of the list would be an added value to diversifying the organization.\n5-C Procedure on Appeals (Article XI) was moved to the end of the agenda, to follow the\nscheduled closed session appeal hearing.\n6.\nORAL COMMUNICATIONS, NON-AGENDA (PUBLIC COMMENT)\nACEA President Marion Miller expressed concern of potential conflict of interest when two\nattorneys from the same office represent the Civil Service Board, and also present the case\nagainst the appellant in a disciplinary appeal hearing. Assistant City Attorney Highsmith\naddressed these concerns and stated that the case is never discussed between attorneys prior\nto the hearing, and Ms. Highsmith's sole responsibility is to advise the Board on procedure\nwhen questions arise. Ms. Highsmith is not there to render her opinion on final Board decisions.\nOn a separate issue, Ms. Miller requested that she receive all of the attachments that go along\nwith the Civil Service Board agenda when it is released. Staff will accommodate this request in\nall meetings going forward.\n7.\nCIVIL SERVICE BOARD COMMUNICATIONS (COMMUNICATIONS FROM BOARD)\nMember Smith noted that he had been talking to Councilmember Frank Matarrese regarding\nphone calls he receives from citizens who are concerned with groundskeeping done by City\nemployees and also regarding city vehicles that are leaking oil on our streets.\n8.\nCIVIL SERVICE BOARD COMMUNICATIONS (COMMUNICATIONS FROM STAFF)\nA position reclassification memo was shared with the board to advise them that a Public Works\nemployee was being upgraded to a higher position. The employee has been performing the\nduties of this classification for several years, and is currently being compensated via our y-rate\nmethod. Ms. Highsmith explained\nthat because the prior hearing to which they were referencing was held as an open session, the\nwitnesses were also members of the public, and could not, therefore, be barred from the\nproceedings. The Board could ask the witnesses to leave the room while other testimony was\nbeing given, but this request could not be enforced. If this were a closed session setting, the\nwitnesses would be sequestered and brought in one at a time for their testimonies.\nThe subject of impartial legal advice arose again, and Ms. Highsmith reiterated the position of\nthe City Attorney's office in that there is no correspondence prior to a hearing between the\nBoard's attorney and the attorney presenting the case against the appellant.\nMs. Highsmith also advised the Board on procedures for handling objections.\nMember Robles-Wong asked that a small change be made to ARTICLE XI. PROCEDURE ON\nAPPEALS under Section 3. NOTICE AND DECISION of the Civil Service Rules which states in\npart \" Within ten (10) days after the hearing is concluded and the matter submitted for\ndecision, the Board shall make its written decision To be more specific, the Board asks this\nstatement be amended to read \" Within ten (10) business days. (J. Chisaki)\nActing Library Director Chisaki stated that this item went to Council last week and it was\napproved. The Request for Proposal has been sent out and the deadline for submission is\nNovember 4th at 3:00 p.m. Library staff is currently working on a question and answer\nsheet on RFID technology to educate staff and library patrons. President Krongold asked\nhow many vendors had RFID technology. Ms. Chisaki stated that there are only 4 or 5\nvendors that she knows of.\nNEW BUSINESS\nA.\nLibrary Building Team (M. Hartigan)\nIn the absence of Mike Hartigan, Board member Butter stated that the LBT met last\nnight. She noted that there have been significant changes to the exterior of the building.\nThe copper roof was eliminated in the Value Engineering process. The Team had to pick\na\ndifferent material and color for the roof. Also, the color of the exterior brick needed to\nchange to match the new roofing material. The team also discussed fabrics and colors for\nthe chairs in the new library and eliminated colors that would not work.\nB.\nAlameda Free Library Foundation (R. Belikove)\nIn the absence of Vice President Belikove, Acting Library Director Chisaki commented\nthat the Foundation has been struggling with ways to raise money. Their first priority is\nto send out letters to solicit donations.\nC.\nFriends of the Alameda Free Library (M. Skeen)\nMolly Skeen stated that the next book sale will be October 21, 22 and 23 at the \"O\" Club.\nThe Friends have started a voucher program for local teachers to purchase books for their\nclassrooms. A marketing class from the high school will be helping with the book sale\nthis season. The Friends newsletter has been expanded and a library information table\nwill be set up during the sale.\nD.\nLibrary Building Watch (L. Krongold)\nPresident Krongold reported that 212 people now receive the Library Building Watch\nnewsletter by email. Mr.\nLambert noted that his term will be up in June and he has had a great experience serving\non the Board.\nLIBRARY BOARD COMMUNICATIONS\nBoard member Mitchell noted that Susan Hardie's retirement was noted in the Hotline\nmagazine.\nDIRECTOR'S COMMENTS\nActing Library Director Chisaki informed the Board about Teen Read Week. Librarian\nKaren Lundstrom will be coordinating a vote on teen's favorite books. Our digital book\nlink Califa, has had 822 hits since July.\nBoard member Butter asked if we had the Easy Reader Voter Guide at the library.
